Greetings, VJ. I just received a package of materials for filing a CR-1 petition, including an affidavit from my spouse's parents. I have the original affidavit plus a certified translation. Unfortunately, the translator wrote the date by the signature block completely wrong, choosing a random day from last summer. The affidavit describes a trip that occurred this fall, before the affidavit was written obviously but after the incorrect date the translator used.

I assume this means the translation is worthless and needs to be redone. Mail from my spouse's country takes a very long time to arrive here, even with express service. Do you think it would be appropriate to use the affidavit and translation and hope no one notices the date, and if we're ever questioned about it, then point out that the original affidavit was signed and notarized on a date that is compatible with the contents of the affidavit? Or, include a note explaining that the translator appears to have made a mistake on the date? Because the date on the original is written in numbers, it would be plain to any English-speaker when the foreign-language affidavit was signed. Or, do you think I need to scrap this entirely?

I suspect I know the answer, I just don't want to face it. :bonk:

IMO, if the date is not correct, the translation is worthless and cannot be used.

Thanks for the answer. I know you're right, I am just working through my denial after all of this waiting. :bonk:

Next question to anyone who reads this: We will be going through a very high fraud consulate, which is why I wanted to get affidavits from both sides of our family in the consulate's hands before the interview. I'm considering filing now with what we have, including my parents' affidavit but not including my spouse's parents' affidavit. Then, when we get to the NVC stage, including a small number of additional supporting documents, including the affidavit. I am aware that may slow us down by a few weeks, but my thinking at the moment is that it's preferable to either not having it at all, or waiting for months while we get a new one mailed to me. Any recommendations on that plan?

You will almost certainly get better replies if you fill in some details; you can add the foreign country to your profile and people will instantly know what sort of advice to give. In general though, my understanding is that you don't need much evidence to have your I-130 approved, but in high-fraud countries you should really load up on evidence for the interview. That said, your interviewer will have reviewed your case before the interview, which means they see whatever you submitted with your I-130, too. And since people say the interviewers often make up their mind before the interview, I'd say submit whatever you have with your I-130 and bring extra copies to the interview, along with anything you come up with between now and then.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...

Thank you. I agree that it doesn't seem to require much to get approved at the USCIS stage, and I have enough evidence to send in with the initial petition, even without the messed up parental affidavit, to get past that step. Since I do want to get this affidavit in front of the interviewer before the actual interview, I am considering having the affidavit fixed in time to send to NVC, once we get to that step.

What I'm asking is whether there is a downside to sending extra relationship evidence to NVC, other than a possible delay.
