I want to bring my wife to the states.

I currently live here in Indonesia with her on a Temporary residence visa. so my stay here is temporary so my domicile would still be USA.

i know i need to fill a form i-130

main question

What all do I need to include with the i-130

back in the states i do not have a job,or anything really i do have a electric bill in my name for years though.

my father would be a joint sponsor of my wife since I do not meet the requirements.

secondary question

But what would be the fastest way to get my wife in the states? ( I am not in a good situation any more ( nothing bad ) just not a good situation any more in Indonesia.)

Filing January 2012.

G-325 (you and your wife)

copy of marriage certificate

proof that you are a US Citizen (birth certificate or copy of US Passport; if naturalized, copy of naturalization certificate)

Evidence of your relationship (pictures, emails, phone records, etc.)

There is no "fastest way." Since there is no USCIS field office in Indonesia, you will have to send your file to the lockbox facility in Chicago. Estimate 7-10 months from the time you file to the time your wife will interview for a visa.

Follow the guide above. Just so you know, YOU have to meet a financial requirement to bring your wife to the US, If you do not have any income then you'll need a cosponsor. Have you been filing US taxes, as required, for your time in Indonesia (even without having a US income?)

Good luck

1. Look at the Guides: http://www.visajourney.com/content/i130guide1 You do not need to be domiciled in the USA, but need to show intent to re-establish domicile, for example proof of looking for a home, job etc. If you still have a valid drivers license, voter record, furniture in storage etc that helps too. Your dad as co-sponsor won't be needed until NVC stage, some months after filing.

2. There is no fast way, it will take 9+ months. If she has a tourist visa, she can visit you for 6 months if you choose to go ahead of her. If you want/have to, you can leave Indonesia now and go ahead of her.

well. not "required" to file taxes on international income unless it exceeds 94,000 dollars and well I didn't even make 10,000 the year I worked. which is under the required for domestic so yeah i didn't file taxes.

and my stay here was/is on a "temporary residence permit" so that alone proves my stay is

"temporary"

One thing i have read.

please correct me if wrong.

and for proving the marriage to be valid. would a copy of our marriage cert, and our sons birth cert and a family photo be sufficient?

I can apply for a k3 visa for my wife after filing the i-130 when it enters the pending status?

it says the purpose of the k3 is to minimize the separation time of spouses while waiting for their i-130 to be approved?

2007-2008-2009 no job

2010 job in indonesia , less then 10,000 dollars not required to file

2011 working in indonesia less then 10,000 dollars not required to file.

Yes what you list is enough for filing, but for the interview I'd have more proof ready, such as joint bills, joint ownership of property, being on eachother's life insurance, photos from throughout your relationship etc.

Forget the K3, it is obsolete. It used to be faster than the CR-1, but they now take the same time when the K3 is even allowed (usually, the K3 is administratively closed at NVC stage).

K3 is almost dead. Based on feedback, K3 route sometimes may take more time than I-130 plus it would increase alot of expenses for later. Since you guys are living together, so there is no separation.

It is very important that you do proper filling of your doc so you can avoid RFE. If there is any RFE, then it would make unnecessary delay.

OK so basically i will be filling out all the editable pdf forums emailing them to my parents in Tennessee and having them send them in to Chicago for my wife and I ( if from Indonesia mail to USA takes 2-4 weeks ) so they will be using a Money order to do this ( we are going to start process Early January ) that's why I am getting everything confirmed =)

so my next question

What is the name to put on the Money order?? for the i-130 fee?

You are mistaken here as well.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

You are mistaken here as well.

Well then help me out here. my employer did not file taxes for me here or register me for them, they paid me in cash, they basically did not do half of the legal things required here in Indonesia. that was 2010 i have no proof of income. 2011 i just didn't work. so then what?

i know if you don't work and you live in the states you don't " have " to file if you are a Us citizen. Which i am.

and i have no "proof of income" here in Indonesia. anything i have ever done here was paid cash.

(there is lots of corruption here)

this is just one more reason i want to get my family to the states. employers here do not usually do the legal things required for foreigners working in Indonesia. just so they can save money, and they just pay off the gov officials and employees here to get away with it. ( all common practice )

whenever i went to file a "blank" tax return it kept asking for w2 numbers and T.I.N i didn't have those. so i just did not do it.

i did put this in the attachment letter i prepared for when we are asked for the affadavit of support

"

whenever i went to file a "blank" tax return it kept asking for w2 numbers and T.I.N i didn't have those, i could not find a way to get them so i did not do it."

i know its better to be honest in the explanation letter then to lie so i was just honest.

this is from IRS website

Filing Requirements

If you are a U.S. citizen or resident alien, the rules for filing income, estate, and gift tax returns and for paying estimated tax are generally the same whether you are in the United States or abroad.

Your income, filing status, and age generally determine whether you must file an income tax return. Generally, you must file a return for 2011 if your gross income from worldwide sources is at least the amount shown for your filing status in the following table.

Filing Status* Amount

Single $9,500

65 or older $10,950

Head of household $12,200

65 or older $13,650

Qualifying widow(er) $15,300

65 or older $16,450

Married filing jointly $19,000

Not living with spouse at end of year $3,700

One spouse 65 or older $20,150

Both spouses 65 or older $21,300

Married filing separately $3,700

*If you are the dependent of another taxpayer, see the instructions for Form 1040 for more information on whether you must file a return.

Gross income. This includes all income you receive in the form of money, goods, property, and services that is not exempt from tax.

For purposes of determining whether you must file a return, gross income includes any income that you can exclude as foreign earned income or as a foreign housing amount.

If you are self-employed, your gross income includes the amount on Part I, line 7 of Schedule C (Form 1040), Profit or Loss From Business, or line 1d of Schedule C-EZ (Form 1040), Net Profit From Business.

Self-employed individuals. If your net earnings from self-employment are $400 or more, you must file a return even if your gross income is below the amount listed for your filing status in the table shown earlier. Net earnings from self-employment are defined in Publication 334, Tax Guide for Small Business.

65 or older. You are considered to be age 65 on the day before your 65th birthday. For example, if your 65th birthday is on January 1, 2012, you are considered 65 for 2011.

Residents of U.S. possessions. If you are (or were) a bona fide resident of a U.S. possession, you may be required to file Form 8898, Statement for Individuals Who Begin or End Bona Fide Residence in a U.S. Possession. See the instructions for the form for more information.

mine would be

either

Single $9,500

or

Head of household $12,200

both of which my income was under for 2010

for 07/08/09 with no job i was at 0 which is not required to file

so according to the

""

If you are a U.S. citizen or resident alien, the rules for filing income, estate, and gift tax returns and for paying estimated tax are generally the same whether you are in the United States or abroad.""

i was not required to file.

If you want to know you can live comfortable on 500 dollars a month in Indonesia. where the set the poverty line at 90 dollars or below a month
