She had SOME status when she came into the USA on the K-1 visa, allowed lawful presence in the USA for 90 days.

IF, during the 90 days, she marries TO YOU, then SHE is allowed to file for adjustment of status, leading to a 2 year conditional green card.

Another guy, not you? she could marry anyone she wants, sure - but she'll never be able to adjust from her CURRENT visa (the K-1) without marriage TO YOU.

That's the dealio. She's most likely had a plan in mind all along, but since she's abandoned you and any subsequent marriage? She cannot have further status in the USA based on marriage to anyone, unless she leaves the USA and some other fella files for her, starting all over again.

If she stays in the USA, most likely she'll remain underground for years.

You've been scammed, Sir. Sorry.

What a crappy existence that will be. No driver's licene, no EAD, not being allowed to return home and re-entering USA in cases of family emergency... In short - always looking over her shoulder.

Some day I'm hopeful she'll post here and tell us what her thought process was. If she had played the game awhile longer and had gotten her green card she'd have it made. I hope the guy she split for was worth it!

Sir, if you do anything BUT file notifications with USCIS, ICE, the consulate, and your local police department, you'll be suckered.

Your ex (and that's what she is) has moved out and broken off all contact with you. The relationship, and any chance thereof, is over. The only remaining possibilities are that she will hijack your finances (now) or return with a sob-story and plead to get back together with you (later). In the latter instance, she'll milk you until she gets her conditional green card, and then she'll be gone so fast that she'll resemble Speedy Gonzalez on a caffeine high. Avoid being an idiot.

If you haven't taken steps to protect your finances, credit, and residence yet, you're halfway toward being an idiot. If you accept ANY communication from her, you'll be a full idiot.

1. Notify the authorities and your financial institutions as highest priority.

2. Take her leftover possessions, put them into storage (keeping an itemized list, and ideally photographs of everything), and notify her family where to collect it (keeping a copy of the e-mail or written message of your having notified them).

3. Accept no direct communication from her under any circumstances.

4. Quit looking back; look ahead; and move on. Si, man?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
