Hello, everyone,

my husband is a petitioner, I'm an applicant.

USCIS is asking for income evidence, they say Mail your Federal Income Tax Return for the most recent tax year (we already sent W-2 while filing).

We can not get transcripts any time soon, IRS sent us some random form instead saying they can't sent transcripts due to some changes in the tax info they have about him for 2010 so he'll have to sign some more papers to get transcripts).

We only have W2 and California 8879 Tax Return form. Is that good enough if my husband only worked for 1 company, had no other income? Seems to be simple but I'm not 100% sure 8879 is good enough.

Not sure what an 8879 is. Did he didn't file a 1040 or anything fimilar? If so he should just send a copy of page one and two. The information on those main forms is all the need. They don't only want to see the income. They want to see his tax deductions, income tax, whether he owes, etc...

Does he go his taxes himself or at an agent?

State tax returns are not acceptable. They asked for the Federal return, so that is what needs to be sent.

It's not State Tax, it's just one of California forms for Federal Tax Return.

It actually has all the information they need:

Adjusted gross income (form 1040 line 38, 1040A line 22, 1040 EZ)

Total tax (form 1040 line 60, form 1040A line 37, form 1040EZ line 11)

Federal income tax withheld (blah blah blah)

Refund (......)

Amount you owe (......)

So it has all this stuff, I'm just making sure. He filed with an agent. Also he says he filed Form 1040 but isn't it gone after you file it? You send it to IRS and the tax agent then only gives you a folder with information, in our case it's a multiple page form 8879 plus W2, paystubs...

If he can't get a transcript then he needs to contact the tax preparer and get a copy of the income tax return that was sent in. That is what they are asking for and that is what he needs to send.

California FTB form 8879 is NOT a tax return, nor does it serve as a substitute for a tax return. It's an eFile signature form which the taxpayer signs to authorize an eFile Return Originator (a tax preparer) to electronically file a tax return on behalf of a taxpayer. USCIS will not accept an FTB form 8879 in lieu of a real tax return.

Tell your husband to get a complete copy of his tax return from his tax preparer. He can sign this copy and send it to USCIS, along with copies of supporting documents like his W2. It would help if his tax preparer could prepare a statement that the tax return is an accurate copy of the return that was filed electronically with the IRS.
