Hi All

A quick question

My son (age 14) is living with his mother (my ex-wife) in Canada. If she agrees to let him live with me, can he come to the US right away and do school (Canadian) via correspondence until he becomes a permanent resident and can enroll in school down here?

I am a green card holder and my wife is a US Citizen. If my wife sponsors him as his stepmother, I understand there is no waiting period other than processing time (4-6 months).

Are there any dangers, pitfalls to doing it this way ?

Do I just submit an I-130 once he is down here ? Can he travel back and forth while waiting for the request to be processed ?

Your wife as the USC will need to submit the I-130 for her step son and yes, no waiting time other than processing- 6-9 months is more realistic.

Your son cannot come to live in the USA until he has a visa, but he can visit. Canadians are usually given 6 months, so that should cover most of the waiting period, then he can go back up for his medical and interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
