December 2011 IR-1/CR-1 USCIS Filers

Timeline

Well fhaf would certainly fit within their goal of 5 months. I think my timeline predicts late May early June. However, seems they are moving a little quicker at present.

Don't quote me on this.... but what I have observed over the past few months is that I-130 filers with their spouse in European countries do get their NOA2 before Asian countries such as India, Pakistan, Philippines because of large number of I-130 applicants and lot of frauds as well. I would say most likely you should be able to see your NOA2 in May. And I am expecting mine in June month.

Where does Central America fit into this theory?

I would place it in between 1. North American/European and 2. Asian Countries. Again...... don't quote me on this :) that's just my observation and I may be wrong in this.

I heard that is certainly true of a number of European countries , particularly Spain, but apparently the UK is not so quick.

Hope that May is the absolute latest though.

yes, I think they must be filtering out applications by region as they come in and then issue NOA1 date. And different officers may be assigned to process only applications for specific countries. There has to be a systematic processing method. I heard in the past that typically officer spends less than 30 minutes to review your application and issue NOA2. We are waiting for many months just to find an officer who can spend about 30 minutes on our file :)

Actually USCIS conducts criminal background checks on the petitioner to make sure they even qualify to file a petition. They also do some kind of check on the beneficiary I guess to see if they ever been petitioned for in the past etc etc. I would think there is more then 30 mins involved. If they send for an FBI report I think that takes a few weeks. USCIS also has to verify documents you send in like a divorce decree, birth certificates, etc etc. They send requests to the Department of Vital Statistics of the States where you obtained the documents to verify that they are real. There is a lot more involved then you might think. You know if a petitioner has been involved in any kinds of crimes of moral turpitude or domestic violence, that can disqualify them from being eligible from even filing immigration papers for anyone. This is just some of the things that go on at USCIS.

My wife , petitioner , had a traffic DUI for which she served a jail sentence for a few years ago (only - 1 week). She choose a short sentence in jail over a fine. She has her license back now and is fine to drive.

Is that likely to affect our petition ?

From looking around on other forums, it seems that they do not carry out any criminal record checks on petitioners? The only time criminality comes into it is in respect of the beneficiary and that is done by asking them to supply a police certificate.

The only thing they do at CSC is check validity of the marriage.... That's what I hear.

I heard that they were trying to make DUI convictions disqualify you but not sure, it probably wont affect your case. I think if it was a habitual occurrence like if she had 3 DUI's then maybe she would be disqualified because if you have 3 your usually on probation for a long time. And after 3 or more its considered a felony now in most States. Convicted felons are disqualified from many things, even voting.

OK I know from personal experience that they do a criminal check on petitioners, I guarantee they do it. I cant discuss my personal position here, but I have been through this process before 3 times and I know for a fact that my criminal history was checked. My job requires Homeland Security Clearance and FBI paperwork. I've seen my files and I know in the past that USCIS has received/requested info about me. Validity of the marriage is mainly checked at the Embassy level. USCIS just reviews the marriage papers for authenticity and compliance of their requirements. Like it must be certified copy etc etc.
