December 2011 IR-1/CR-1 USCIS Filers

Timeline

We filed at CSC 12 Dec 2011. It came up on the website as received and said the NOA was in the post. Then, 3rd Jan the online status changed to a message saying "your Form I-130 has been returned by the US Postal Service as undeliverable. USCIS will destroy it in 90 days if we don't hear from you". So we called and they said what happened was the NOA 1 was not delivered and that this is a problem with the system. They said they would send out a new NOA1 which they did, and that the form was being processed in the normal way. The replacement was undated and the online status still says the same message about a returned I-130. We have called a number of times and been told that they can not change the online status now. At first they said wait 30 days, now they just say "it's being processed". Every time we log in it just says that, quite annoying. As the original message on the online status said 12 December 2011 received , hopefully that's the date to go by?

Still haven't heard a peep.. Im in the UK and my Wife is pregnant in the US and we're praying for another miracle , that the visa is issued before her due date of 9 July. Seems impossible unless NOA2 comes in the next fortnight , NVC process flies by and interview in London is moved forward for us.... Really don't want to be flying back to the UK for the interview in July or August, aside from the cost... Taking the bar exam in July and having a newborn to look after. Stressful isn't the word for this process.

ok so they sent out the first notice NOA1 to you but the post office said they couldnt deliver it to the address that you had on your papers. So when the post office sent it back to USCIS as undeliverable, USCIS flagged your file as having a bad address. They notify you and you call them and they say they are going to send it again. Now, you get the second NOA1 letter that they sent but has no date? hmmm i'm pretty sure you go by the first date they gave you. The date they received it give or take a day is usually the NOA1 date.

Yeah, the various people we spoke with just said that the message referring to the I-130 being returned was actually referring to the NOA1 being undelivered. The form I-130 was, we were told, being processed in the normal way. Apparently the system is not able to say "the NOA1 was returned" it has to say "the Form I-130 was returned" absolutely no idea why, or even if this the case but that's what they told us. Seems strange nobody is able to Change the online status. Just adds to the worry seeing a notice saying our application was returned and will be destroyed whenever we check the current status you know?

Hello everyone !!! Here is one more December filer ! :))

I've sent I-130 for my spouse who is in Bosnia at this time. I've received NOA1 but nothing yet ! It's been 4 months and 13 days and still nothing.....

Here is my message from them : '' On December 8, 2011, we received this I-130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case."

I just hope it will be soon, maybe in May... Good luck to all of you!!!

They cashed the check/money order right? They confirmed that they got everything fixed on the case paperwork issue when you called them right? You did end up getting a NOA1 in the mail, just no priority date right? I think your ok. Send them a letter and ask them if everything is ok now, they will send you back a letter saying if it is or not. Thats what I would do. It might take a few weeks for them to reply but at least you will have something additional in writing to ease your mind.

They cashed the check/money order right? They confirmed that they got everything fixed on the case paperwork issue when you called them right? You did end up getting a NOA1 in the mail, just no priority date right? I think your ok. Send them a letter and ask them if everything is ok now, they will send you back a letter saying if it is or not. Thats what I would do. It might take a few weeks for them to reply but at least you will have something additional in writing to ease your mind.

We emailed the CSC and they said:

"The petition is at the California Service Center pending review and adjudication;

allow five months from the date of receipt for this process to occur."

And it was signed by the officer dealing, so think it is all under control. Check cashed.

Yes, no date on the replacement NOA, because it was a replacement I guess.

I think your ok, but i would also sent them regular mail and get a reply back on paper. Thats what I meant but email is ok and if they replied in email make sure u save it.

Thanks for this. I just double checked my replacement NOA1 And it does actually have a priority date but not a date of Notice. The priorty date is 9 dec 2011.

How's it looking for dec fillers generally ? Any more getting approved right now?

yep, CSC is still working on remaining October filers and have started processing November filers. I think we need to wait for another 2 to 3 weeks to start seeing some action for early December filers because most of NOA2 I am seeing are coming in from 1st to 15th November only.
