how far overdue was yours?

I don't think ours was overdue at all. My wife had called earlier, I think in March, and she was told to call after May 1, because that's when our five months had passed.

inna Jamaica, still not get NOA2 :( i did however call them yesterday and they say it can still take up to another 30 days... a wah gwaan UGH!!!!! im ready to get it while im here, and now gettin nervous to if i am gonna get it. :(

Hi everyone. My PD for my NOA1 is Dec 5th so i decided to call USCIS this morning. The man said that they are processing Dec. 15th and since mine was before that he sent a service request to CSC. He said if i don't hear back in 15 days to call back. I hope this is good news since he didn't say NOV. 15.

Just to let you know this is my 2nd time going through the process. I filed for my ex husband in 2008. We split up after being seperated for 15 months (our relationship was not very strong before he left) I was 17 when we got engaged and we married after i turned 18 and he was 23, i think we just married too young. So long story short, I remarried again ( husband EWI from Guatemala) and we have 2 children together.

I am not surprised that you have not received NOA2 yet. Because you already filed for your ex-husband just 4 years ago and now filing again for your husband. So CSC will do an extensive check on your case and your ex-husband's present status.

Is your ex-husband still in USA on the basis of your sponsorship? It seems that your marriage got nullified before conditional green card period was over, so you must have reported your marriage status to USCIS at that time.

Check your "Last Updated" on the official USCIS website. It shall show when your petition was touched.

Background checks and all comes only after they actually look into your petition but if they have not even touched your petition since they received it (indicated by last updated) then it is just collecting dust in some folder. I hope you hear a positive response in 15 days but if not, I suggest you contact your congressman.

my application was never updated with "Last Updated" ever since the day when NOA1 was issued. I checked my status at 10pm on 5/11 and was not showing any changes, but at 12:30am got a text and email saying NOA2. So I really doubt they update "Last Updated" until there is a status change on your application.

He didn't get the conditional he got permanent resident. We have talked to acouple of lawyers and they say the only thing that should change is that my ex will havetoo wait 5yrs to get his citizenship. I know they will be harder on us but there is nothing to hide. I will have whatever they need when they ask. I was the sponer for my ex and all i haveto do is count him when i sponser my husband andwe make enough money thatit will be ok. I am already preparing my waiver because i have faith that we will be approved.

Yes, my point is that you will get approved. But CSC does more background check on your previous marriage which involved immigration process.

How did your ex-husband receive a permanent resident card (green card) without any condition? I-130 applicants do get green card with a condition, and I believe it's for 2 years and then you have to file to remove the condition after 2 years. Did you file I-130 for his petition? I am not an immigration expert, but that's my understanding. Make sure what you are thinking is correct by checking USCIS. I don't rely on lawyers a lot and like to do homework on my own for all this.

If your married more than 2 years when visa is issued you come in as IR1 with 10 year green card from what I read here. :whistle: I'm still waiting for NOA2
