Have called to be told to wait 30 days. Sent an email to CSC also. will up date you in due course.

Just wanted to post my times here so others in the same position know it is normal.

When I called USCIS in early last week, I was told that I can file service request once you have reached 5 months mark.

When I called yesterday, the rep told me that my petition was within normal processing times and to call back after 2 months!

This after waiting for 4.5 months...I wanted to yell at her...but I'll be calling back once I reach the 5 month mark.

11/04/11 Got Married

06/08/12 - NOA2 Received

07/02/12 - Case arrived at NVC

07/12/12 - Received case #, IIN, and BIN, gave e-mail addresses

07/13/12 - E-mailed DS-3032 from Beneficiary's e-mail address

07/23/12 - AOS bill invoiced & PAID

07/24/12 - DS-3032 accepted, IV bill invoiced & PAID

07/25/12 - AOS bill appears as PAID, IV bill appears as PAID, AOS Package sent, IV Package sent

07/26/12 - AOS and IV Packages delivered to NVC

08/01/12 - AOS/I-864 accepted, Checklist Issued for DS-230

08/13/12 - Responded to Checklist

08/20/12 - IV accepted, Case Complete

My agent thought that also, but when she tried to run it in her computer it wouldn't let her and told her that there is a 30 day period to wait before u can do the service request. I think that is well established, maybe someone else can confirm?

Going through the NVC is easy for the K-visas because the NVC just sends your approved case from USCIS to the Embassy you list on the I-129f.

The section I put in bold is not a correct statement because if a petitioner were to list an Embassy or Consulate that does not conduct K visa interviews, the NVC will not send the petition to that Embassy or Consulate, they will send it to the proper Embassy or Consulate. An example of this would be if a beneficiary lives in China and the petitioner wrote Beijing or Shanghai on the form. Since K visa interviews are only done in Guangzhou, the NVC would send the file to Guangzhou, even if the petitioner wrote another location.

But for the I-130 which is the CR-1 visa aka Greencard , they actually process you and approve the visa, this is why it will take longer for us to get through NVC.

"Approve the visa" is an incorrect statement. The NVC does not approve visas, they function as intake of documentation prior to the file being sent to the Embassy or Consulate for the interview. The decision on whether or not the visa application will be approved is made by a Consular Official at the Embassy or Consulate.

Your suppose to know if the Embassy you select on your form can do a K visa process/interview before you file it.

NVC assigns, qualifies you, reserves, any way you want to put it, a visa, The Embassy is the final approval. The Embassy has the final say. National VISA Center makes available a visa in your case and the Embassy interview approves it.

NVC qualifies and makes a visa available to you, let me rephrase that, IMMIGRANT Visa available to you. Then they send your case to the appropriate Embassy and set your interview appointment. The Embassy will have the final say. K- visa cases are forwarded over to the appropriate Embassy for processing. K-visas are not immigrant visas. NVC does not approve your K-visa. Maybe that was not clear in my previous post because I assumed people would know what I meant since this is not a K-visa forum, its a IR-1/CR-1 forum and I was referring to the Immigrant visa. The NVC National Visa Center most certainly does approve your case for a immigrant visa, without NVC approval of all your documents you cant continue on to the Embassy phase.

Also, if you list an Embassy that can not conduct an interview or process your case, NVC will assign you to the appropriate Embassy and notify you of the change. But the general message is correct, NVC sends your case to the Embassy you select on your form or to the appropriate Embassy.

So CSC replied our email today it said that they are in the process of adjudicating and we'd hear within 35 days. It was a generic response that I have seen on forums a number of times.

So the 5 months passed on 12 May 2012, then the call center said on Monday to wait 30 days and today CSC is saying wait up to 35 days.

Who knows what is going on.

Don't take my opinion for truth, because I really have no idea what goes on there... but I would not be surprised if that's a way for them to buy themselves time and get you off their backs for a while. My wife called and she got basically the same answer as you. She then received our NOA2 in the mail 4 or 5 days later, and the approval date was the same as the day she called.

my hubby just called and was told they're still working on nov15...generic response!!! i'm so hating this.. they've been on nov15 since apr20..goodness!!! impatient now:(

They still have people that filed from OCTOBER waiting so what's really going on :blink:

and people from january are getting approved... i don't understand their system..so frustrating..
