I had my N400 interview today, applied for N400 while my "I751" was still pending,i was told by Immigration Officer to wait for the notice for I751 interview, if i don't hear anything in 90 days contact USCIS by making a INFOPASS appointment, did any of of you had experience like mine, or heard of it before , appreaciate any help or information.

The N-400 cannot be adjudicated before the I-751 is. So filing for naturalization is like putting fire on the burner the RoC petition is cooking in. I'd call this a smart move.

The I.O. is correct. The wheels are now in motion and I actually doubt that you will have an RoC interview at all. More likely is that the I-751 will now be approved quickly.

If you apply 90 days ahead for your I-751 say July 1, 2010, can apply for the N-400 July 1, 2011, give or take a couple of days, but a year later. Since it can take close to 90 days to even get your one year extension notice on your then expired conditional green card, if you are lucky to get your ten year card before your one year extension expires, you will only keep it for a couple of days. Then have to turn it back in.

If you don't get it in that time frame, have to either get an I-751 stamp in your current valid foreign passport or apply for an I-94 by bringing in two passport photos. Hopefully your officer will give you enough days so you will get your ten year card. If not, have to go in again and get another extension. Up to you to keep yourself here legally, in a sense you are, but legally cannot work nor travel without those extensions.

USCIS and ombudsman was worthless on this issue, took lots of pressure on my senators office to discover where they buried out I-751, but they did find it, and she got her ten year cards just days before or interview. Only to have them take it back.

Did hear about some that got their US citizenship even without their ten year card, but when dealing with the USCIS, you are not dealing with a well organized government agency. You are dealing with strictly individuals, so no telling what they will do or how it will turn out.

The N-400 application under marriage was far more extensive than the I-751 in terms of evidence to a married relationship. Not only everything we supplied for the I-751 had to be submitted, but even all that stuff we already sent them for the AOS.
