K1 - Married but haven't filed AOS yet

Thanks to all who've replied. More info than I thought I'd get! :)

Honestly, I just wanted to know if I would make it to some 'deadline' before the actual K1 expires. I understand that the point of a K1 is to actually get married, and then goes from there. I just wanted to get things done, AOS including, before the actual K1 expiration deadline, so as to not ruffle any feathers or create any headaches for the long-term. Having said that, I understand that the 'marriage' part is complete, therefore, we've met the K1 requirement of getting married within the 90 days. As far as the AOS and all else, the sooner, the better. SSN is already in our hands, so I don't think that implicates anything.

All in all, thanks to all for the info!

God bless!

You are missing the point here. The OP is talking about NOT filing AOS. You HAVE made application for AOS and you were able to get licensed based upon your application. Without your NOA1 showing you made application you would not have a license now. There is nothing misleading about this.

And you have missed my point. I understand what the OP is saying. I realise that I needed proof of applying for adjusting status in order to get my DL. What I was saying was that you don't need to have had your status approved before you can do that. If you look around on this forum, you will find people who have applied to adjust status who cannot get driving licenses, and I have read on other posts besides this that you cannot get a DL before having your adjustment of status approved. I am simply saying that is not always the case. So, no, I did not miss the point. Thanks for the post, though - I realised that my initial post wasn't clear enough.

We'll have to agree to differ on that, as you are missing my point and I am not prepared to continue with this. Also, I think the OP has enough information to answer their question.

You can't. You need a SSN. The NOA is notice of action from USCIS.

I believe this depends on the state:

States that require an SSN for a driver’s license with no exceptions (5):

AL, DC, HI, NJ, and WV.

States that don’t require an SSN for a driver’s license (7):

GA, KS, MD, MN, MS, OR, and VT.

States that require an SSN for a driver’s license only of people who have been assigned one or are eligible for one (34):

AZ, AK, AR, CA, CO, DE, FL, ID, IN, LA, ME, MA, MI, MO, MT, NE, NV, NM, NY, NC, ND, OH, OK, PA, RI, SC, SD, TN, TX, UT, VA, WA, WI, and WY.

I'm not sure how current this information is but I know a few years ago you did not need an SSN to get a driver's license in MN but you did have to prove lawful presence.
