I am hoping to send in everything tomorrow for AOS.

I have a question about the I-864. My brother is co sponsoring and I am sending in his Birth Certificate and also his tax transcripts for the past 3 years. The last 2 years he was way over the poverty level but for 2003 he was finishing up school so he didn't meet the requirement, is that going to be ok?

My other question is this: he has a job now but picked up another part time job which he will be starting within the next two weeks. Should I add this to his current employment? I was just going to put the one job he has had since Jan but I am not sure if I should also put his new second job?

so far as I know, if you sponser is over the poverty line, it should not make a difference

The reason I wonder about listing his second job is because if we get an RFE for something related to the I-864 I wonder what they will think if he then has 2 jobs listed and not just the one he has now.

His information on the I-864 should be accurate at the time of notarization. If he is not yet employed in this second job, I can't see how you can use it.

I only sent the most recent year's tax return (2004) with our application. They RFE'd us and I sent my 2005 tax return. So they approved us only showing 2 years above the poverty line. I'm not sure about this, but since they only technically require one year, and since your brother was under in 2003, I probably wouldn't even send 2003.

Ok thanks Jenn, I am not goign to try to complicate things so I will just leave it as it is with 2004 and 2005 taxes and his current employment listed without his new job that he has not started. Thanks you're the best!
