Hey,

I need your help please.

I applied for a K-1 Visa and waited 5 months. Then I got denied because I forgot to send in all the information. I hate myself for messing that up. Now they gave me the option to do a "motion to reopen" or to start a completly new case. If I start a new case then it's gonna take 5 months all over again. My and my fiancé would hate to wait that time again. I miss her soooo much! Now my question is did anybody of you did the motion to reopen? Is that gonna take less than 5 months? Or is it gonna take longer? And they told me on the phone that I have to pay $640 to do this motion to reopen. Is that correct? (it didnt say anything about that money in the letter where they told us the case got denied). And can I come visit her in the US just for like a few weeks while we are applying all over again or doing the motion to reopen? And what would you recommend for me to do anyway? A motion to reopen or a new case? The money doesn't matter by the way.

Please somebody help me here. But only answer if you know what you are talking about.

I've never heard of "getting denied because of forgetting to send in all the information". What did you "forget" to send in? Did you get an RFE? Did you answer the RFE?

You are still " messing up". You forgot to include the info people would need to offer advise. Like what you forgot to send in.

You called & were told how much the motion would cost but want a different answer? Its is correct.

Do we know what we are talking about? The real question is do you? There has to be more to this than you have said.

Its unlikely you would be granted a tourist visa after someone files an immigration petition for you. You will be asked about this if you apply. Study the strongest ties rule prior to attempting a tourist visa. Make sure you know what you are talking about.

Ok I forgot to put in the topic that I didn't send anything except the 129F Form and the fee of $340. Then we waited 5 months. We didn't get ANYTHING from them in that time frame. Then they sent us a letter that we got denied. Nothing else happend. They didn't have any other reason to deny me. I mean i'm just a normal person with no criminal record or anything.

So you didn't send in any supporting documents with the 129F? Just the actual 129F and fee?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yeah sounds like what was said.. :bonk: Anyway i hope someone can help u without being mean about it.. i know this process is hard, frustrating and stressful.. sorry and good luck

May 12th 2011 Received Letter from NVC stating info has been forwarded to Lagos consulate office

July 14th 2011 Received Fiancé Visa packet and interview date (via email)

Sept 20th 2011 Interview day! Visa not approved.. Requesting more proof :-(

Sept 28th 2011 Second interview scheduled for early December :-)

Dec 5th 2011 Interview rescheduled consulate office caught fire :-(

Dec 6th 2011 Visa APPROVED!!!! :-D

Yes. Unfortunately. That's the reason we got denied, because we didn't send in all the information needed.

Ok - you will have to start over again - they sent you RFE's for the info missing - if you didn't respond, that would deny it.

If you can prove you never got them - then you could probably open the case again - however, I would just eat the cost now, and re-file a brand new petition - this time - ensure you follow the rules/instructions exactly.

(it would be cheaper than trying to re-open the first petition)

My gut feeling is that requesting to re-open would not help you (time-wise) being you are missing so much from your original petition packet, it will take time to fight the battle to re-open then your file will be put back in the system, then they will send you an RFE for lots of missing items, then your file will be put back in the pile again.... waiting, waiting waiting.

Start fresh, it will probably be faster.

Uncalled for.Is it so hard to leave your personal opinion or feeling out when we respond to a post?

Isnt your post centered around you own personal opinion? What advise do you have to add to the OPs post? They cautioned you to not respond if you dont know what you are talking about.

While I dont have to explain myself to you I will say you simply dont understand what I said in my post. You can see by the OPs responce they realised we need more info. So did they know what they were talking about? No. This then requires people to try to understand or just not respond.

The subject begins to get clearer as they provide the correct info.
