My husband came over for a visit to attend a conference in Vegas with me...well, now we're married! And pretty confused about the process! I've downloaded the instructions and forms for the

i-30, g-325, i-864, i-485, and i-765 (wheew!)and the complexities have me considering an attorney. Any thoughts on the worth of using an attorney? Also, i-864 says that I need to pay and file with the state?? I'm confused. It says to give to an immigration officer but then lists something about a lock box.

I think I put this post in the wrong forum...anyways, I'm married. He came over on a VWP to go with me to a conference, and well, we got married. I'm now navigating through the waters of immigration which are lengthy and winding to say the least.

Anyways. I want to move forward with insurance and banking, can I do that now or do I need to wait?

Also, i-864 says that I need to pay and file with the state?? I'm confused. It says to give to an immigration officer but then lists something about a lock box - where do I send this?

Yes, the 864 is not mentioned anywhere on the guides and my question comes directly from the immigration site instructions.

Scroll further down on the link I gave you. It's #13 in the I-485 package section. Everything will be submitted to the Chicago Lock Box.

As for the insurance and banking it's likely he will need an SSN for that. Since he's adjusting from VWP status I'm not sure when he can get one. I'm sure someone will be along shortly to answer that one.

Your husband won't be able to get an SSN until he receives his temporary EAD card, which will allow him to work while the AOS is pending. This will take around 70 to 90 days from when USCIS received your AOS package. Once he has his EAD, he can apply for the SSN, which will in turn make all those other issues related to bankign and insurance easier. He should be able to open a bank account without the SSN though, I know I was when I was still on a student visa. Mine was with bank of america, and they did not require an SSN at that time at least. Insurance is another story, I don't think he can get one until he can prove he is authorized to be in the US, i.e. when he has his greencard.

There is no fee for the I-864 when filed with AOS. You will just pay the $420 fee for the I-130 and the $985 plus $85 biometrics fee for the I-485. There are no other fees associated with the forms themselves, but of course there's the cost of the medical exam, photos, copies, etc.

Everything is send to the Chicago Lockbox together. Read the VJ guide, it's very detailed and clear and will help alot alonsigde with the USCIS instructions.
