Timeline

Hello everyone my lurking days are over and I am preparing to file for my husband to come to the US.

If my understanding is correct we first file the 1-130 and once approved send in the 1-129f for the K3.

Is that correct?

Also, we were wondering where to file the application as far as processing times.

He is Nigerian living and working in Ghana. What is the best route these days

Where are you living in Nigeria, Ghana? It's not where he lives its where the US citizen lives. If you are a permanent resident of nigeria you can file there at the Embassy and it is way faster like 3 to 5 months compared to 8 months to 12 months filing in US.

But his interview all that will have to take place in Lagos.

the U.S citizen or LPerm resident needs to initiate the I-130 for spouse visa.. start with www.uscis.gov and then some links here on vj for step by step suggestions.

If he's in Nigeria, interview likely in Lagos.. all da best

I do not think direct filing is still allowed in Lagos ( I may be wrong) except in exceptional situations. Petitioners residing abroad have been advisd to forward their application to the Chicago Lockbox( pls verify)

the time frame depnds on your status: USC or LPR?

you send in your I-130 to chicago lock box and then they will forward it to the center depending on your state of rsdience and somtimes due to case load at centers. these California Center appears to be moving like snail.

if he is based in Ghana and you can select there as your consulate I would suggest you use it cos people going through Lagos appear to be having a hard time but then again a lot of factor come into play in most cases such as some of them having been in previous marriages, etc, too short relationship etc.

if this is your first marraige for you both then by all means choose lagos( as it will be easier to have your kids at the place for the interview) .

meanwhile hope you guys are building proof of relationship such as marrauge certs, visits to spend time to together, family photos, as couple, with kiids, with family members and attending various functions and ceremonies together, phone records.

Also he will need polci certificate from ghana when he gets to that stage (usually after NOA 2 arrives)

Just another FYI u might want to consider doing everything through Lagos becuz Ghana is very backed up there are people who have been waiting up to 2yrs to get an interview date.....also look at tge guides here on VJ it tells u step by step what to do. (tab at the top of the page says guides) good luck to u!

Thanks for the input. I should be a bit more detailed I guess.

I am the USC living here in the states while my husband lives in Accra and his children (11 & 9) live in Lagos.

We married in the US and separated in 2007 and he returned to Nigeria.(left near his visa expiration..there is NO overstay issue).

Now after reconnecting nearly 2 years ago we are going to get back together and make a go of it.

His situation in Ghana is flexible enough where he can travel to Lagos as needed and in fact that is

where his first visa was issued. So if Lagos is faster these days we can go there. I vaguely recall that Ghana

was extreme slow in their process whereas Lagos was more apt to deny your petition if you were not rock solid in your

presentation and details.

In your case filing through Lagos is going to get you to the interview faster but at either consulate there is going to be scrutiny of your marriage. In Ghana you are also more likely to get a second interview (sometimes for very trivial things) which will delay you by extra months. If you have super solid evidence then I don't see you having too much of a problem in Lagos. I would also suggest that you be in Lagos for the interview.
