Hi.

I am very new to this forum, so bear with me. My daughter who is a US citizen, is currently in England and is trying to fill out I-130 for her husband, who is British. They plan on coming home in February, so can he legally come over here, even if they dont' have the I-130 filed yet, or do they have to wait until it is approved? My daughter is extremely homesick and wants to come home ASAP!!!!! Can anyone help me out here? Thanks in advance!!!!

It may be very difficult for him to get a tourist visa being married to a US Citizen

unless he can show strong ties with the UK (lease on apartment, letter from employment, etc)

He will have to wait to get his immigrant visa before he can move to the US. He can visit the US using the VWP whilst he waits.

I thought a UK citizen can come visit here without a visa for 6 months? Coz US citizens can go to UK as long as they are back in the 6 months time frame.

He can come on the VWP for 90 days. If he happens to have a tourist visa he can visit for 6 months. The UK's policies have nothing to do with the US's.
