hi everyone!

im a little worried, what would be a reason for Border control to deny someone to go into the USA even with a valid visa?

NOTE:Ive never been to the USA and my first attempt going to the USA was last year to visit my boyfriend. I had too much luggage uknowingly and did not have a return ticket because me and my bf didnt know our scheduals (but i did intend to come back to canada within the 6months) and from that i was pulled into secondry security for awhile and refused that day into the USA.I had to fill out a bunch of papers aswell. The officer told me if I brought enough ties and such next time ide be perfectly able to go to the USA though, but yet i still have never attempted to go after that.

(P.S im Canadian and was going through the YVR airport in Vancouver)

after that me and my boyfriend applied for a k-1 visa. my interview is coming up very soon and if we do get approved with a visa, im scared being denied by an officer at POE because of my last attempt into the USA or for some other reason. Im dead scared of leaving my apartment and everything to go live in the USA with my visa and then being denied at POE and having nowhere to go or stay because I dont know anyone or have any family where I am, so the thought of being denied at entry terrifies me.

how likely are you to be denied by and border officer even with a valid visa such as k-1? anything I should do or any tips?

Shouldn't be an issue; if you are granted the K-1 visa, then you will have a valid reason to come into the country.

If you use incorrect language or look or act terroristy or try to smuggle drugs or contraband, then you might have issues.

There was a Canadian with a criminal record who was refused entry when they had a visa. Cant remember the name but they had posted about it on VJ, they ended up marrying instead and filing for a CR-1 with a successful entry that time.

From what I read -someone can correct my explanation- If you have K-1 Visa on hand, you've been granted come to US based to the purpose of the visa. My guess, the reason why you were denied before because you did not have much evidence to proved that you would going back to your country by that time. According to your story, you had bring many things, no return ticket, and then probably raised suspicious of security officer that you might be intend to stay.

Don't worry about the previous denial. I was denied TWICE last August at the border (Montreal airport and the Montreal land border). It never even came up at the interview. And POE was a breeze. Just handed over the sealed envelope, signed a few things, gave my fingerprints, and I was out of there.

(This according to an immigration attorney) Even on attempted entry with a K-1 visa, CBP can deny entry, for any reason that the consulate could have used. However, this is quite rare, because CBP figures that the entrant has very recently been put through the wringer by the consulate, so all of the potential reasons for denied entry have been dealt with and won't be a problem.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Actually even more applicable to CR1 because the scrutiny was even more thorough.

correct language matters.

It was my first business trip to the UK. When asked at the UK immigration why I was entering I said " For work". That was the WRONG answer. The correct answer was "For business". I got pulled off for extra screening and third degree interrogation until they were convinces that I was not going to seek employment and was being paid by a US company.

I was denied entry twice before my interview in Montreal. The POE was easy, never even asked about the previous denial of entries.

Now, you should disclose the denial of entry at the interview and be totally honest about it, but it is really a non-issue

Good luck
