Hello, this is my first posting.

My Fianceé received a Blue Sheet at her interview last week in Guangzhou. My Fianceé has a illegitimate son whose father was a Japanese citizen. The father became gravely ill and needed surgery that could not be performed in China, so he went back to Japan and was never heard from again. That was 3 years ago. My Fianceé believes he is dead and that is what we put on our documents. During the interview my Fianceé submitted to the visa officer a "White Book" stating that she has legal custody of her son. The visa officer wants a death certificate of the father. My Fianceé went to the Japanese Consulate in Guangzhou to see if she could get the death certificate and was told they could not help since they were never married. The Blue Sheet simply states under the items needed, sons fathers death certificate. The father is also listed on her sons birth certificate.

Any suggestions on how to satisfy the Blue Sheet request?

Your help would be greatly appreciated.

Do you have the child's birth certificate listing the father, hopefully also listing his passport/country of origin?

I would approach the Japanese consulate again. If you can convince them that the child has a direct connection to the father it may sway them to research death records. I wonder if there is way to simply prove abandonment, and then use that documentation to satisfy the RFE?

Another avenue (but not cheap) would be to hire an attorney in Japan to provide the research and obtain the death records.

I suggest a different approach:

Get a copy of the child's birth certificate in YOUR hands. Get to a Japanese Embassy in the USA and ask for proof of death on the father. [Go, not call]

I suggest a different approach:

Get a copy of the child's birth certificate in YOUR hands. Get to a Japanese Embassy in the USA and ask for proof of death on the father. [Go, not call]

Along with your approach, do you think Brian_N_Phuong idea of having the Chinese courts say the father is missing or abandoned will help satisfy the RFE? Is it possible to have the fathers name removed from the childs birth certificate?

Did a bit of research last night on getting a death certificate in Japan, and out of Japan.

Either the Japanese Embassy can start the work or

you can hire an agent in Japan to obtain the document.

IMO an attorney in Japan isn't needed, just the equivalent of a USA-based paralegal.

I would go the route that Darnell suggested as its the easiest, quickest, and cheapest.

If the Japan route fails, then look into proceeding through the Chinese court system and declare abandonment. Most likely would require profesional legal assistance for that option, but it's a viable solution and preferable to doing nothing.

Hello All!! Happy New Year!!

To update: I have just returned from celebrating the Chinese New Year with my Fiancee in China. What a GREAT time!!! Prior to leaving the U.S., my Fiancee resubmitted her custody papers with a slight change in the wording. The initial custody papers stated that my Fiancee had custody of her son. We had the wording changed to " Full custody". While I was in China, my Fiancee received an EMS from GUZ stating that her K1/K2 visa's have been approved. YES!!!!!! My Fiancee is just waiting to get her passports returned to her with the visa's inside. I am planning on meeting her and her son in Shanghai at the end of February to help her through immigration in Chicago. I am very excited for us to start our new lives as a family!!
