My fiance friend has a son with a u.s citizen and her fiance is lost in how to apply for them to come to the usa on a k1 can any one help with what forms need to be filled out for them both to come she is from thailand (they are thai married but he did not reg. at the usa embassy) any help would be great thank u all

If married legally in Thailand then they would file for a spouse visa, not a K1 fiance. Have them follow the Guide here on Visa Journey.

Yes i agree they need to read the website, they married in thai but they didnt reg. with the u.s embassy which the u.s is not going to recognize as being married, just looking for positive help, i guess what im asking for is how do they apply for adding their son? I myself have gone through the k1 process before and am goint throught it again im just not sure about adding their son ......

If hes born to a US citizen parent who fits the requirements, they would file a CRBA and get a US passport for him.

The baby could not travel on a Visa of any kind to the USA if it is a US citizen.

Their son is a USC if his father is a USC. They need to apply to get his passport etc. Can't remember what this is called but other VJ members will know.

This is not always the case, if the child was born before the parent became a USC and the new USC parent does not fit the requirements for CRBA then they could not bring the child to the USA as a US citizen.

Marriages don't need to be registered with an embassy. If legally married then they pursue a spouse visa.

Marriages don't need to be registered with an embassy. If legally married then they pursue a spouse visa.

Actually in Thailand you need to go to the U.S. embassy and get a letter saying you are free to marry. It's a Thai thing. Then you have to register it with the Thai foreign ministry.

Maybe so, the Philippines has a similar requirement, but that isn't the same as having to register a Thai marriage with the US Embassy.

If you get married anywhere on the planet the US recognizes the marriage unless it's polygamous.

The child will not be issued a visa if the child has claims to US citizenship. IF the father qualifies, the child should be issued a US passport, not a visa

Follow the guides, but be aware, if the CO believes the marriage is legit, a fiance visa will not be issued, even if the marriage is not registered. Keep in mind, Thailand is a high fraud country, do everything to the "T"

Nope...

If they are married (even if they did not report the marriage), the are INELIGIBLE for K-1 visa. Would need to file CR-1 visa for the wife and son will not need visa if he is USC (he would enter USA on his US passport)...

All K-1 filers sign a form stating they are single and free to marry. If your friend files K-1 visa and the Consulate finds they are married that is MATERIAL MISREPRESENTATION and can result in lifetime ban for entry.

Do things the correct way. File for Cr-1 for the wife, CBRA and US passport for the child!!!

As long as you did not file that marriage with the Amphur’s office then just file for the K1. The embassy in BKK understands this. People actually use pictures of their Thai wedding ceremonies as proof at the embassy interview. The important thing is to not have that wedding registered at the Amphur’s office. The U.S. will recognize it as a legal marriage if you do.
