I'm a greencard holder & I filed a petition for my wife & daughter in March 2010 under F2-A category. Now, NVC is requiring me to submit an Affidavit of Support (I-864) showing the last 3 years of my income. I arrived here in July 2009 & landed a job in January of 2010. Next year I will file for my 2nd year income tax. My annual salary can support my wife & daughter based on I-864P but I dont have 3 yrs of income tax. My father-in-law is willing to help however, his annual salary can support for only one person. Will the NVC allow me to file for an AOS showing only my 2 yr income tax? If not, how do I go about this?

Thank you in advance for your help.

P.S.

My father-in-law & I don't have the same residence hence I can't use form I-864A.

Hi! :) I'm not so sure if we have the same requirements given the situation. But my situation is that it is my mom who is an LPR who filed for an F2A for me. She started working last Jan of 2009 then filed for my petition March of 2009. AOS was requested by August (maybe) of 2010. By then, she only had 1 year to show for income tax. She filed it anyway and things were okay. :) I'll have my interview next week. If by then your question doesn't have a definite answer yet, I'll let you know what happens to me. :P

Thanks for your reply, ellione28! How comforting it is to know that I have the same situation as with your mom. I will pray for you that you will pass the interview. By the way, if you're 16 yrs old or above I suggest that you obtain a CENOMAR (Certificate of No Marriage or singlesness) from NSO & bring it with you on your interview so you dont have to go back to the embassy just in case they'll require it from you.
