K1 visa affect fiancee benefits?

Hi me again,

My fiance was looking at claiming for childcare, food stamp and medical benfit. Now we are wondering, we need a sponsor for the I-134 will the benefit then be calculated from the sponsors earnings or my fiancees, as she will have to state that I am a member of the household (once I'm there). We are assuming the sponsors earnings would be too high to qualify.

The thresholds for public aid are much higher than for the K-1. She must make 125% of the poverty wage for a K-1 and up to 300% for food stamps.

A US citizen never loses their ability to receive benefits reagrdless of applying for a K-1 visa and the pupose of the co-sponsor is to asure YOU do not become a public charge. She can be a public charge, YOU can't. SHE has to assure the government you WON'T be and that is what the co-sponsor is for, in her case.

There is no question on any affidavit regarding her receiving public aid.

That said

The approval of the visa is not guaranteed and a consulate officer or later Immigration officer for the AOS COULD deny the visa or your gren card based on the fact that she is receiving public aid. There is a part of the law that specifically allows them to do this. It is usually not imposed or even questioned.
