Hi All,

I am on F1 visa and currently working on OPT.

I have a very important question regarding my Wife's dependent visa.

We applied for dependent visa ie F2 and were rejected twice.

First time ,in july'11, visa officer did not see any document but said that he is not satisfied with her financial support.

He asked only 2 questions ie when u got married and what will you do in usa?

Second time, in august'11 ,VO asked same questions without asking for any document.

He said tell your husband to apply for H1 and then apply for h4.

I tried for H1B in NOV 11 (delayed due to delay in client letter) but unfortunately the quota got exhausted quite unexpectedly fast.

I see only 2 options...

1) Either wait till april'12 and apply for my H1B and her H4...or

2) Apply for visitor visa now for time being ....or

Kindly suggest me what should I do ?

She has been denied twice within 4 months, I don't believe she would be persuasive enough to convince IO to issue her a tourist visa or non-immigrant spouse visa any soon. I guess you can try it when you obtain your H1B then try H4 again next year. What is your nationality?

hey nancy ....i have another doubt ... if i apply for f2 third time and suppose if its rejected this time also then will it create any problem for h4 in april .....

she is not going to be granted an F2 nor B2 because there is zero chance she will be returning to India...same as you. There are no papers, notarized or not, that will change that simple fact.
