specific questions about I-485

Hi everyone,

I have some questions about the I-485 and I hope someone who has been in my situation can help me.

1. On part 1, should I use my husband's last name or my maiden name?

2. On part 2, which option should I mark? should I mark a. an immigrant petition....... or h. other basis of eligibility........ My husband is an USC so I don't if that matters for this question.

2. He is USC, you are immediate relative so A is the option.

1. Use the name you want to appear on the GC. If you changed your name to your husband's after you got married and that's the name that is on your marriage certificate, then use that one.

i had the same question and on my marriage certificate it doesn't say anything about my new name, however, when i asked a clerk that gave us our marriage certificate if I am free to use my husbands name on any legal forms, she said i was free to, so I filled all my papers with my married name and where it asks for other names, i put my maiden...

Not every state changes the names on the certificates. In some states you take the married name just by beginning to use it and changing your legal documents just by showing your marriage certificate to SSA, DMV, etc

I and my wife where married in Mexico and then she got the K3 visa while outside the USA. Therefore her marriage certificate and birth certificate and K3 visa have her maiden with the paternal and maternal last names on it. Example : Karen Oris Capo Vega. The paternal last name is Capo and Vega is the maternal last name.

On part 3 of form I 485 it clearly states that she should put her name exactly as it appears on the I-94 Arrival/Departure Record. So that is pretty clear that she would put Karen Oris Capo Vega there in part 3 section. In summary, what isn't clear is what she should put in the first space under last name in Part 1 of I-485. Please help! Thanks.
