So thanks God i spoke to live agent at NVC and was informed that DS-230 is good but AOS form section 25 information doesn't match. So let me assume, when i filled the I-864 i only check second option (optional) but i didn't check the first box and wrote the total income for 3 years?

Should i have checked both boxes and write income for last three years?

Man i have a headache..

I need advise as i am not going to waiti for the RFE letter to come in snail mail and then send.

You put a total of 3 yrs as income?

Your supposed to send last years tax return 2010 (other two yrs optional 2009, 2008) but they always want to have all three years anyway...so you should still send in 3 yrs (at least at ISL they want it)

The income is for the CURRENT year not one in the past that you already filed tax return for...this is your expected income for 2011.

And you should wait for the RFE letter as i think you need to send that in with the docs you resubmit. I may be wrong, we didnt get an RFE but from things ive read you can't send it until you have that and it needs to be submitted together.. somebody correct me if im wrong..

You are correct, a checklist letter would need to accompany the items the checklist is requesting.

Perhaps something is lost in translation. You should check the second box as optional if providing three tax returns. You then provide a total income for each of the 3 separate years. Total income is line 22 on the 1040. Is that the number you entered? If not, that's what doesn't match.

Hmm. I just mailed the revised I-864 with doc cover sheet as agent from NVC on phone said, i could send it without waiting for the checklist. The issue she said was just section 25 not 22 current income. I just checked the optional block on 25 and didn't put anyhting in the boxes for three years income. i think that caused the RFE. i also had sent 3 yrs tax returns.. So now i know rfe can be issued for stupid things and hold the whole process..

so now i hope that they will accept it..

help me God almighty...

We just filled in the I-864 with my husband this morning, and he was wondering about the same thing, but I told him to check the 1st box anyway, since this one is NOT optional. The example form helped us a lot.

NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

We just filled in the I-864 with my husband this morning, and he was wondering about the same thing, but I told him to check the 1st box anyway, since this one is NOT optional. The example form helped us a lot.

You check one box or the other, not both. However, I would not expect a problem checking both as long as you provide the three tax returns.
