Tourist visa with pending I-130 (F2A)

Hi,

My wife (from Malaysia - recently married) wants to visit USA (and me). I already applied for her F2A (I-130PD 06 SEPT 2011, in "initial decision").

Is it likely that US embassy will deny her application for tourist visa because she has a F2A pending?

Yes, because they will wonder why she would return, instead of using a tourist visa to change status to student (F1) in order to study basketweaving or something equally 'challenging' so she could remain in the US waiting for her priority date.

Far too many spouses of LPRs have 'forgotten' to return so the qualification bar has likely been raised considerably.

I doubt any kinds of visa would be denied because she already has intention to immigrate.

It is understandable that 'intention' to visit US with immigration pending can be questioned. I guess it doesnot hurt to apply, if they deny - fine ... she doesnot plan to immigrate in 2 years anyway.

Well i just got granted a B1/2 with my mom , and we have a pending F4 which the CO asked us about it and asked if we will use it to immigrate when it completes in 2014, then he warned us not to abuse with the visa otherwise our F4 will be canceled .... and than he granted us a 10 Year B1/2.... So im saying go for it, u never know, everybody was saying we didnt stand a chance of getting a visa, but we did and got granted a 10 YEAR :D:D

Thanks for sharing your experience. I will tell her to take a shot and see. other than the fee, nothing to loose.
