I got a family (Children) in the US, they are green card holder for more than 2 yrs. as of now. My family (including two kids) are legal to enter in the U S due to her mother petition. The fact is my future wife (Family) were not marry just only live in at that time. I was apply two times a tourist visa but I'm not lucky to issue a visa by the consul. The second time I'm applied again, my family gave me a supporting documents in order to show to the consul during my interview but still denied my application. I'm trying to apply again (3rd time) but I need to consult you guys. Could you pls. help me regarding this and your suggestion is highly appreciated. Thank you very much.

Well 2 important things, it has nothing to do with luck nor to do with your family

The tourist visa is about you. what are your ties to PI? It is clear you have immigrant intent with so muh family in the US, you have to so strong ties to PI in order to convince (which you clearly haven't yet) the CO that you NEED to return to PI.

Many people make a mistake and show why they want to go to the US, it is the opposite, show why you must return

Good luck

Yes, if you had been denied twice, the chance to get one in near future is too slim. You must show the US Consulate that you have no intention to immigrate, and an obvious evidence is strong bond to your home country (family, assets, work...)

Your family sponsors your trip, that means you have no bond with your homeland, there would be no chance to obtain a tourist visa.

Thank you for your reply,

In what way to show not to intent migrate? I have strong ties, I got a house and lot, health insurance, bank account, as well as job. In DS-160 form i stated that I'll shoulder my plain ticket and asking me that. I'm said yes, I'll shoulder my ticket. Thank you so much.

The only thing you can do is to persuade the IO about your visit. But you have been repeatedly denied, it is not a good sign at all. I suggest you shouldn't try to re-apply anytime soon, because it would look like you are desperate to travel to the US. Good luck.

Thank you for your suggestion. If you don't mine, what is IO? Actually, for me I don't want to apply a tourist visa again. I'll wait her petition of my family as a FIANCEE but she insist to re-apply again because of my two kids. She need to accompanied my two kids as well, and to help at all. Any good suggest from me? Thank you gain.

The fiance route would probably be best for you since based on your family ties to the US an IO would reasonably believe that you have an intention to immigrate. If your fiancee insists on you reapplying for the tourist visa then give it some time... a lot of time. Good luck!

My wife still holding a green card for almost 3 yrs., Can I petition me to migrate in the US, What type of Petition she do,and How long it will takes her petition? My wife also wanted to re-apply a B2 visa, is there can help the affidavit of support and ITR's forms she sent to me that can represent to the Consul during interview? Thank you very much for your response.

Let's see if I understand your situation correctly:

1. Your wife is a green card holder, a U.S. Legal Permanent Resident for 3 yrs.

2. You got kids and they already immigrated to the States.

3. You are married and your wife wants to petition you to America.

In this case, I would advise you to read the instructions on the USCIS page, [here's this link: http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=be1ea6c515083210VgnVCM100000082ca60aRCRD&vgnextchannel=be1ea6c515083210VgnVCM100000082ca60aRCRD]

It should provide you some guidelines on how to proceed with your application.

Good luck!

Hi DJG,

Thank u for the website that u gave it to me. It's very helpful to me what is LPR but I'm still confusing because I'm applying again a tourist visa. Is this reasonable from the consul if u apply B2 while u married of LPR? Your reply is very appreciated again. Thank u very much.

You won't get a tourist visa to go to visit your wife and children. You have a stronger reason to stay in the US (family) than to return to PI.

Have your wife begin the petition for you to get a spouse visa. That is your pathway to the US.
