Timeline

I am a USC my husband and I applied for and were approve for both the 129F and I-130 basicall at teh same time. Our intent was always to bring the kids however, we did not file an I-130 for the kids. The I-129F was dropped because we could not have two visas going at the same time. Will the kids be able to come with my husbands I-130?

unfortunately no, uscis requires that you file an I130 for every person you petition, including stepkids

No. File the I-130 for each child ASAP and ask that they be expedited.

I take it your two petitions were approved the same day and also arrived at the National Visa Center the same day. The I-129F was then administratively closed by NVC. Does this sound like what happened? Please confirm as we've seen some potential procedure changes lately and this would be back to the old way.

Yes both were approved within one week of each other. I was told that I could add them at them Embassy. Is that true?

Shortcuts? There were shortcuts? Please tell me about the shortcuts. When I submitted the I-130 for my husband I included the childrens names. I submitted the G-325 for the children as well along with orignal birth certificates and face page of passport. I also included them as part of the Affidavit of Support. I just did not submit the I-130 because I assuemed that would take years to get approved and they could come with the k3 and k4 visas. Now what should I send with the I-130 NVC has seen all their original docs and forwarded them to the Embassy?

Not enough information. There are shortcuts to getting through NVC. Have the I-130 petitions for the children reached NVC yet.

No I have not submitted the I-130 for the children yet. Our interview is January 24, 2012, it hardly seems enough time get it processed before the interview. However, if there is a short-cut maybe there is time. I called both the NVC and USCIS and they both said it is a short turn around. I was thinking we would wait until after our interview and submit once we have my husbands finalized. The second part is the original Birth certificates are with the Embassy in Ghana, I submitted them with my husbands again assuming they were part of his I-130. What short cuts are available?

There are no shortcuts until after the I-130 petitions are approved. They children will not be coming with your husband and he only has six months to use his visa once it is issued. Unless you want to start all three over again, or want your husband to leave his children behind, do NOT proceed with your husband's visa issue until the childrens' I-130 petitions have made it to the Immigrant Visa Unit in Accra. If only an I-130 for your husband is at the Embassy and the I-129F was administratively closed by NVC, there will be no visas for the children until their I-130s are in Accra.

Unfortunately, this is the apparent unintended consequence of NVC's new policy regarding I-129F for spouse. Even when the K3 and K4 were fully available, the step children would eventually need I-130s approved in order to adjust status.

The first two responses in this thread told you that the children could not come with your husband based on his I-130. Believe it. Adjust your plans accordingly. File those I-130 petitions and ask that they be expedited. Reason for expedite is that your I-129F was administratively closed by NVC.

Since you got through NVC in six weeks, it appears you used the "shortcuts". Do the same for the children.

So, if you've not filed the I-130s on the children yet,

do so.

With EACH I-130, have a cover letter requesting an expedite, state that the parent's I-130 is approved,

and on the outside of the packet - in big red letters, write

Expedite, approved I-130 on parent exists

It's interesting you have an interview date. What went down at NVC for NVC document intake?

Just one NVC number.

Because there was only one I-130 and one immigrant. File an I-130 for each of the step children ASAP.

Critical also is to delay the interview. Unless you want the parent to leave the children behind, you don't want a visa issued that will expire before the children have their visas.
