so 5 months passes and I put in a service request, I get this back telling me bascially if I dont hear something in another 6 months to call them, our lovely dysfunctional goverment at work. I think we should have just gotten married and she would be here sooner, note they can not even give any date(s) as to how long a " backround check" takes. I can buy a gun in an hour, but cant bring the woman I love here to marry in 6 months????? below is the response pasted below.

The status of this service request is:

The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.

Could be both. Most likely the US citizen. Most often caused by a "hit" in the automatic check and they have to establish that he is not THE John Dillinger.

Best way to reduce the time on these is a full and complete G-325a, not that it will fix everything but it is the only thing you can do. USCIS service centers have an FBI presence in each one and the FBI office in that service center will do the manual background check which amounts, again, mostly to waiting in line for your turn to come up. You will likely never hear anything about it, your friends and co-workers are not going to get phone calls. They will do their thing and your petition will get approved.

Good news is that this means your case WAS adjudicated (which cancels out the "timeline", USCIS has done their part) and the FBI has improved their turnaround on these in the last couple of years.

In terms of the USCIS this is the same as an RFE. They adjudicated the petition, something was lacking and that is being resolved.

Yes thats the thing, they dont even say but looking at it I would assume on the petioner, that would be me, but my god its just insane. It would be diffrent had they said we are doing blah blah blah and we expect to have this accomplished in 30 days or 60 days, but to say within 6 months, that would put us over the one year from 129f filing. My friend said its just a form letter and stall tactic.

It is definitely a form letter written by an agency that is not doing the manual check, so it is "conservative". Better to have you be HAPPY that they did it 30 days than be pissed off when it take 4 months. 6 months is "more than enough". USCIS is now waiting to hear back from the FBI and they do not control that so they cannot say with any accuracy and NO, the FBI will not tell you either.

The main problem comes in when it involves a name match to foreign people on the bad guy list (whether you or your fiancee) because foreign governments are not always so quick to respond.

Thanks Gary for the Info, I guess better something than nothing, when I spoke to a guy there he said if there was a problem they would have already told me so I take it as you said perhaps they need more information, cause the paperwork was full and complete. Hopefully it will go quick. It was however a bit dissapointing.

I say just go ahead and call them everyday, put in an info pass and keep calling and ask to be escalated. some of them doesnt even know what theyre saying.

I wonder what's going to happen in my case, since I am a victim of identity theft and have some things in my background...:/

I would think you would be fine so long as when you filled out your 129f package you didnt omit anything that they ask about on those forms. I think as Gary/alla mentioned, something triggered a need for more information on mine. It just bumms me out that there is nothing I can do to fix it or move it along, I had originally figured 6-8 months for the process but when your approaching month six and get a letter saying it could take another 6 months it definitly takes some wind from your sails.

Ok - Talked with USCIS today, and they said that as long as the identity theft had been reported, that I shouldn't have any hick-ups. However, they're doing background checks now (aka "Initial Review"), and will let me know if they need more information. So, I assume that either they haven't had any problems, or they haven't started yet.
