i-130 and i-485?

p.s. I'm currently in the US as a tourist

I'm married to a US citizen. We are applying for a K3 Visa.

Do we have to send the forms i-130 and i-485 together? or the i-130 first and wait for our Alien number to send the I-485?

it's confusing. did you come to the US on a K3 visa? if not and you entered on a tourist visa, you don't qualify for a K3. the K3 is to come to the US, you are already here.

it's confusing. did you come to the US on a K3 visa? if not and you entered on a tourist visa, you don't qualify for a K3. the K3 is to come to the US, you are already here.

no, the K3 is a visa to come to the US. after that you still have to do the adjustment of status, but you are already here, so the K3 doesn't apply. you will directly go through the AOS process.

the i485 is for adjustment of status.

no, you file both concurrently.

what you don't need is the i129f for the K3 visa you will file the AOS packet. there are many more forms than these 2. check the guides.

isn't wise to go back to her country and have the spouse file the I-130? wnt they consider it visa fraud (for marriage purpose)since she is here on tourist visa( no intent to immigrate)?

What are the chances of being approved...i knw we each different experiences but I am just concerned and wondering....

As long as she didn't make specific material misrepresentations upon entry, as the spouse of a US Citizen, she is entitled to adjust status. If she used the VWP, there is no appeal of the decision.

You can be jealous that people like my wife, from China, don't have this option or just be happy for those who do have it. Jealousy will bring no happiness to you. It is what it is.
