timartinez What!! Now this scares the hell out of me....l hate this rfe business..it sucks especially if you have to keep on revisiting your past..l just hope they wont ask me any rfe...am really scared the fact that im in removal..its 11months for me..

Missymd,dont be afraid all vawa cases are different,some people got approvals without RFE,so just keep the faith and hope.why are u on removal?

timartinez gather more evidences of the violence and the bonafide marriage, check the letter to see what they are asking for and submit asap.Good luck.

Hi i am new here. kindly help me with this VAWA thing. My question is when you file vawa petition through a lawyer, then they will send all the information to the lawyer or they will send it directly to the petitioner.

farhan123 yes they will send all they need to send to your lawyer,if you are paying to much to your lawyer,u can try catholic charities dey help VAWA victims for free.Best of luck we are on the same boat.

I have an approved i130 I'm seperated fom my spouse have documents of 2 times I went to the hospital for deep cuts and hit in the groin and eye and it caused corneal abrasion .. I have pictures of the cuts and eye. And emails where she is asking for money And telling me she controls me abd she owns me. I'm scared to go to the police because she said she can get me reported and make hell for me .. And she said she has the upper hand because she's a citizen n a girl. I'm currently in removal proceeding got out of immigration last month I've heard people wait months and months for a court date. Can I file vawa i360 while I wait for court date? Or should I just wait for cancellation of removal under vawa ? I know I have both options .. I've also gotten a DUI but I've volunteered and the shelter and library n going to continue .. Will that work in my favor?

CZRR yes you can file Vawa while you wait for a Court date,no problem at all.You won't be able to have right now cancelation of you your removal based in Vawa, because your case wasn't approved yet,once approved then your removal will be canceled.

I have a DUI and have violated my probation ( i know i know bad) But I'm done with it did all my classes and everything ..will this effect my case as I have to prove good moral character.. Should I keep volunteering or what else can I do to shove good moral character? I have no police record because my wife has a baby I consider him my son but he's not.. So I'm scared if I call the police they will take him away from her and I have no legal right over him. I don't want him to go through the system.. So I have no police evidence just medical papers and pics from 3 incidents of abuse scratches cuts and bruises. Help me!!

CZRR Vawa cases are taking 12/16months to be adjudicated. Stronger cases do not get approved faster at all! Go to file a report against your wife and get a restraining order against her.I know you like the child, but are you worry they may take away the child, seriously? who cares?. She didn't think twice before battered you and she keeps battering you. Time to put your foot down man.

does someboy know if you have to renew the prima facie letter even if you are not receiving help from government I applied for VAWA june 2011 and the letter expires 12/25 thanks...

Yes ,it is better to renew your prima facie if it expired.

Guys guess what!My VAWA was approved today,it took 18months exactly.i am sooo happy,Do not give up your approval is on the way.Thanks for your support,this forum really helped me alot. :dance:

missymd my 3rd and 4th prima facie's was valid for 60days each,though my 4th one expires in september 2012,its bin 15months since i applied.

May God help us out of this misery. :innocent:

I'm not sure how to post my own comment here. But I have some questions and maybe my case will help some people too. I had a I130 filed for me in 2010. After me and husband had frequent fights where I had bruises and our oldest son watched everything my husband left me. I have a 4 month old baby when he left. My parents helped me so I could afford a lawyer and that's when I found out about the vawa. I applied for it in march 2011, I received my workers permit within 3 months, and I have already had 2 prima's I recently received an REF my lawyer says its sorta of a good thing cause that way we know they are looking into my case. I had an appointment with my lawyer in the 1/02/13 and she will me sent my information back to Vermont. I'm anxious so I hope I get some response soon. I hope this is helpful for some people! :) I would like to know how many people that have applied for the vawa are still with their actual husband and how long did your process take? Thanks
