Does anyone have an experience on the processing time and cost of annulment in the Philippines? I'm a US citizen wanting to separate from my wife due to her dishonesty with money and for her constantly lying about going to her 1R-1 visa interview (she has "missed" a total of 8 appointments). I considered myself separated and am seeing a woman who may be my potential future spouse.

Since you're a U.S. citizen, why the need for an annullment in the Philippines? Just get a divorce in the USA.

She missed 8 appointments? That seems more like - not interested in going to the interview.

Since you're a U.S. citizen, why the need for an annullment in the Philippines? Just get a divorce in the USA.

She missed 8 appointments? That seems more like - not interested in going to the interview.

Philippine law is only relevant for her, not you, because you live in the US. If SHE was filing SHE would try an annulment.

Obtain a divorce in your home state here in the US. That's all you need. It's a legally recognised divorce all over the world. Your soon to be ex will then need to register it for HER to be considered divorced but you'd be good to go.

Thats silly. She may never show for interview 9 according to you. The Consulate will ask why she missed 8 previous interviews. I WOULD THINK.

Just because your married does not give her a Visa. Call/E-mail the Consulate and withdraw your Petition. Give your/her information: http://manila.usembassy.gov/wwwh3023/contact-us.html

Remember, don't make her out to be bad. You admit your seeing another woman while youre MARRIED.

I understand your point and I will indeed take it to heart. I know in the case I am the bad guy as well it's just I have been in this situation now almost 5 years soo (still i know i know not a good excuse).thank you all but one question the woman I may marry is also a Filipina, wouldn't I have to annul to marry her

No you wouldn't. Your WIFE needs to annul for HER to marry someone else. Divorce for you is fine.

Just file a divorce there. You are the one who initiated it so Philippine Law doesn't apply to you. If she wants to remarry, then your soon to be ex wife will just file the finality of the divorce in the municipality where you got married and get an annotation from NSO so her marriage to you will also get dissolved here...not sure how it exactly works but she will be legally free because of that. She doesn't need to file a separate annulment.

"Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law."

If you are marrying another Filipino in the Philippines, you just need to show a Legal Capacity to Marry: click here to marry. If you can obtain a divorce decree in the US, you can surely get this.

If you are filing for K-1 visa for another Filipino, same thing, you just need to show your divorce decree/s.
