Hi there,

I am having a problem what to do first or second. And I am not sure which route is proper and legal.

Currently, I am on my last stretch of H1B visa and will be submitting pre-wailing wage for my greencard process as EB2.

I am planning to marry my girlfriend end of next year as well and she lives in Cambodia.

Now, I am assuming if i get my greencard before than, should we marry first or should I sponsor her to come here as student (F1-visa). Or should she apply for a tourist visa.

If I get audit for my greencard, I think I will still be under H1B visa. Does this means I can bring her to USA as a non-working spouse?

With the current situation, currently I am 28 yrs old and she is 20 yrs old. And we have met for 3 months.

since there is no guarantee that she will be granted an F1 or B2 visa, to save on time, i say your best route is to marry her while your waiting for your gc, so that the chances of you being able to bring her over will be higher, and still high even if you remain an H1B.

I am only thinking of possibilities cases and figure what to do.

Zen,

Do you know what is the processing time for a Eb2 greencard process from a H1B ? Currently, my lawyer has already file for the labor wage certification and we already advertise my position accordingly.

Seems like my best option is marrying her in between my H1b and green card process. and apply for a H4 visa the same time. Wow, lots of planning to do on my part. Engagement, weddings, approval from parents etc.
