Second K1/ Advice/ideas/thoughts...

Dear VJer,

As few of you guys are aware about our path of first K1,It was denied at New Delhi Embassy without giving any legitimate reason and We met twice after that; had an engagement ceremony, lots of pic. with family.. lots of more evidence. We are going to send a second K1 petition very soon and your thoughtful ideas will be a great help for us this time.

May 04,2010 --- Sent NOA1

May 05,2010 --- Touched

May 10,2010 --- Received Hard copy of NOA 1

July 12,2010 --- NOA2(Approved) AND sent to NVC

July 16,2010 --- NVC Received

July 19,2010 --- NVC Left

March 22,2011 --- USCIS sent a notice saying petition expired/ Can apply fresh one

April 12-26,2011-- Her Second Visit (Had a nice Engagement Ceremony)

Nov 14-22,2011 --Her Third Visit( It was wonderful time together but very sad when we said goodbye)

Dec ??,2011 -- Second K1 Petition sent to USCIS

Wow..looking at your timeline, seems that your petition was approved so fast (2 months?). So, I was wondering why you had problem at interview session. I could not understand that. I thought the faster approval of I-129F, the easier would going to embassy and visa on hand. wacko.gif. I guess am wrong.

There would have been a reason on your denial notice. What did it say? if it was denied because they thought your relationships fake then that's fine, but if it was for any other reason you have to overcome that first.

"Visa interview indicates that the petitioner and beneficiary do not have valid relationship to qualify for a k1 visa. This visa application is refused under section 212(a)(5)(a) of the immigration and nationality Act(INA). The petition is being returned to the NVC for review and revocation.

Any further questions should be directed to them. Please consider this case closed at out office."

Okay so she didn't properly reply to questions? didn't provide information that was asked for? She would have had a feeling or been told in the interview when she failed.

Provide ALL the documents that show the true relationship between you and your fiancee, and try the luck again! New Delhi is worst to deal with this type of situation in India, I know.

One thing has absolutely no bearing on the next. At the USCIS stage all the petitioner and beneficiary need to prove is that they are both legally free to marry and that they have met 1 time in the last 2 years.

The Consulate determines if there is proof of a sustained and ongoing relationship.

Additionally, USCIS falls under the provisions of Homeland Security, where the Embassy falls under Department of State. Two completely different auspices of the US Government and USCIS approval does nothing to sway the opinion of the Consulate.

Timeline

We did the double K1 route. Seeing that you had a list of things they were looking for make sure to give them that and more in your second petition. Usually a second approved petition is much harder to deny at interview but not impossible. From the day you send the petition start gathering evidence of your ongoing relationship. Make sure the photos you submit with the petition cover as large a time frame as possible and include as many family and friends in public as possible. Write a statement of relationship that shows why the assumption that you don't have an ongoing relationship is erroneous.

This will not be over quickly. You will not enjoy this.

we had a 2nd appoved k1 petition and in my own experience it went smooth.. in fact during my interview the CO or the pre-screener didnt mention to me my previous K1... btw, my 1st k1 is not denied we just voluntarily withdrew it bcoz of some circumstance during that time...

N-400:

June 19, 2017: Case is in Line for an Interview
June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!
