If your story checks out true, then you really don’t need no senator letter or anything.

You MIL can let the CO know what happened and why she had to extend her stay, if your story is real then most CO would take that into consideration and would not think anything fishy is going on.

Most CO’s understand that given your situation you need someone to help you with Kid.

They also understand the a visitor to the US is not work authorised.

I know child care is not allowed with B2 ... but CO's also use there little dicsretion, also if OP's story checks out then most CO would consider the situation and would not decline the next visa coz his ML got her previous visa extended.

My view when somebody goes for a visa extension is that there is no harm doing so as long as they have no plans to 'visit' the USA anytime soon thereafter.

Even where they have a multiple entry visa, how believable is there request going to be at the POE next time.

In this case they have to get beyond the Consulate and PoE with an admission of having broke the terms of their visa as well.

If they feel that lucky, enter the Lottery and come in on an EB5!
