So, if that were to happen, what would be the outcome if the application was approved by USCIS?

If Prop 8 is ruled invalid by the courts, and a California serviceman (or women) gets married to a member of the same sex while overseas in a country that recognizes same sex marriages, and decides to ask the Chaplain's Office to assist in their immigration case, and the service they belong to approves, then the USCIS might be pressured into allowing that case to proceed, or at least have grounds for DOMA to be challenged in a friendly 9th Circuit Court.
