The N. Delhi embassy was never going to give us a visa.. they jerked us around for 2.5 months and put us through hell to finally deny us as visa application is expired. So they win. we give up . ...

Ha!!! We're going to married and begin round 2. has been a weekend of tears and anger.. then sorrow then anger... and now we start round 2 and its another year and a half probably .. but no one is going to stop us .

Met 10/2009Married 9/13/2012 in indiaFiled I-130 12/4/2012Assigned MSC case # 12/6/20122/14/2013 called uscis and on 1/30/2013 case moved from MSC to Chicago local office.4/17/2013 letter from senator durbin's office that a inquiry will be made on my case and to allow 30-60 days6/7/2013 NOA2 !!!!! while I am visiting my baby!!!!7/12/2013 letter from senator and copy of USCIS email to them stated our case heading to NVC 7/23/2013 NVC # assigned!!!!!!7/25/2013 called for Invoice identification number and had them add yash's email( Yash sent DS3032 via email nex day)7/29/2013 rec'd email from NVC with DS3032 and AOS invoice, paid today $88 mailed hardcopy of DS 30328/1/2013 AOS pkg mail via fed ex8/6/2013 AOS rec'd @NVC8/12/2013 DS3032 accepted IV invoiced8/15/2013 IV fed ex'd9/9/13 dreaded checklist asking for DS260 b/c DS230 obsolete<p>9/11/13 electronic submission of DS260 accepted

Timeline

Visa applications do not expire. It was the I-129F petition approval that expired. When you marry and file an I-130 petition, that approval of THAT petition will not expire but they can still deny a visa. Whatever the reason for the denial this time, you'll still have to deal with overcoming it.

the denial was for this reason the expiration.. and they found that the evidence we submitted was inconclusive.. whatever that means.. they interviewd him and his family extensively we had everything in order and still denied. So regardless we are still going to go forward as we have the right.

That totally sucks. Two others were denied by Delhi this week. Team Erra is getting married this month I think after being denied last year and trying to fight it.

I hate when they give the BS reason it expired. They know darn well they can choose to extend it. They are just taking their sweet time in reviewing, waiting for it to expire so that they don't have to list a legitimate denial reason that will get them in trouble if it is overturned.

I say get married and start the visa process over and GO TO THE INTERVIEW.

I can't recall having read any denied marriage visas from India, even for interracial couples. They seem to slide right through like butter.

Only one I have seen that had issues in the IR-1/CR-1 route was a marriage based on different religions (Hindu/Muslim). They were still able to overcome it.

Try to make more visits if you can to see your fiancee as well. Those immigration stamps speak volumes...

Thank you guys Bec and Dave... I am definitely going to be going to india more this tme around especially since we will be married.. I will never be able to cope mentally if I dont. We are thinking to get married in jamaica and then apply.. because the wait time is less and if he can go to jamaica without a visa.. so we are preparing for that now.. Dave i will definitely need help and appreciate the offer! I appreciate the kind words and support...

I truly believe that the ONLY reason Dipu and I weren't denied is because I was there. We had lots of support and notarized letters and we spent about 110 days together total but they still had a 221(g) filled out and ready to hand over. They threw it away when they were introduced to me.

I'm so sorry to see you going through all of this - it's a royal pain [been there, done that]...

About Jamaica [trust me when I say I've looked in the past at EVERY available way for Indian nationals to get somewhere even remotely close to North America] make sure you have all in-transit visa stuff worked out. Once upon a time [at least a year ago] you would need transit visas to just pass through airports even with ongoing itineraries in the US [at least at EWR you HAVE to pass through immigration even for connecting flights]. I looked at going through Dubai, US, Canada, Europe, the whole thing...and couldn't figure out a way to travel only with visa-on-arrival schemes. At that time there were no non-stop flights to Canada [thinking a transit visa to Canada would be easier than a transit visa in the US] - then taking a flight to Jamaica [or any of the islands]. I'm hoping things have changed...

I must have not see the part where they thew away the 221g when you were introduced!

Sadly, India is a high fraud country and interracial marriages are not the norm and it also being a fiancee visa it adds to the mix as well.

There was an interracial marriage in my group (April 2011 Filers) that had 0 issues with the process. They were married and had a child together.

Number 1 rule of dealing with Delhi in my opinion - USC should be present!!!

I spent days in the consulate during 2009 trying to get stuff resolved and I would watch the interviews [since there is nothing else to do while sitting there and waiting] - having the USC [even if they are also of desi extraction] makes things a thousand times easier. Because of the fraud issues the COs are very suspicious. Questions can be answered, interaction between the couple can be seen, and the fact that the USC made the trip speaks volumes.

Yes i agree .. i did not go to the first interview.. but went to the second which wasnt really a interview..( long story!!! anyhow.. I think now had I gone to the first interview.. we would have had a better chance.. but I am thinking now.. we want to get married so whatever has passed is done and this time we are wiser and will do it in a VERY meticulous way. I am going to do extensive research about jamaica and see to make sure we can do it there.. there are not too many places he can go without a visa that are convenient for me also.. but now we are even more determined to finally get married and that way even if we have to go through any AP we are finally committed and no one can take that away.

So sorry you guys! :( Is this only Delhi that has these issues? We're going through Mumbai and we've had other issues dealing with them as we don't have an interview date set yet. I will be going - if they ever let us know when that will be! Best wishes as you go on to "Round 2"! I hope you get a better outcome this time.
