Starting the Process of the I-130 Form

I met my husband online, we talked for 1 year and we started our relationship in 2007, back then i was finishing my tourism and hospitality career and he was studying his Surge Tech course.

The first time he got a passport was because he wanted to come to meet me in Nicaragua, and after that our relationship got stronger, and we were traveling back and forth all this years just to see each other. Even when i was studying my mba in spain we got to be together, we spent our first christmas with our family in 2008.

Last year he proposed in granada, we got married on October this year.

Before we got married we went to see a lawyer and he told us we had a really good, strong case in our hands.

Now we are just starting the procees, he lives in indiana and i live in nicaragua. He is a US citizen and i have had US visitor visa since 1992.

I miss my husband, and i have a few questions about this process:

1. How long does it normally take?

2. Can i go visit him with my visitor visa? or is it too risky for the process?

3. If during this process my visitor visa expries, is it advisable to get my visitor visa again? is it even possible?

I was hoping maybe before june (his bday) i could be there...but i have heard about so many cases...sometimes it take 4 months and some other times 4 years.

Could you please let me know how long did it take in your case?

We are sending all our documents, including emails, pictures of our relationship and our wedding, and copy of our passports showing how many times we have been traveling to see each other.

Timeline

There are 3 steps:

1 - I-130 Journey - which may take up to 5 months.

2 - NVC Journey for AOS & IV - Average time up to 2 months

3 - Interview - Average time - up to 1.5 months

So average complete process time can be 8 to 10 months.

We filed in February and got our interview for October. It really depends but if everything goes right, I would agree that it could take between 8 to 10 months like iwaiting has stated. Be sure to stay proactive and don't wait for the NVC to send you anything.

In regards to your visitor visa, yes you could try to visit him but keep in mind that they could always deny you entry if the CBP officer believes you are planning to stay in the U.S. I never traveled while we were going through the process, but other VJers have stated that if you are able to show strong proof that you are planning on returning to Nicaragua then you shouldn't have problems. I think the fact that you have had your visa since '92 and have traveled many times shows your good faith at making use of your visa. But, again, this is totally up to the officer. Keep in mind that even if they denied your entry while the process is going, that will not affect it any way.
