whoaw! now i am confused

hello again VJers... 2 weeks ago my fiance sent our package to USCIS for K1 petition, then we found out that our check was over by 10 dollars, then we didn't get anything in 2 weeks nor get the package back since they said they will return the package because our check is over by 10usd, i asked my fiance to call USCIS today to ask what happen, the guy told to my fiance that our paper is under review, i don't know what he mean by that under review (sorry guys i just really don't understand) and that we have to call in 2 weeks so that we will know if it is approved or denied or have rfe,and that they will send message also by email and mail, my fiance told the guy how will that happen because we don't have NOA1 plus our check is not yet in cashed. i don't really understand what is going on with our case, i am confused :( i will ask him again to call again next week, i have a friend also that didn't have NOA1 and NOA2 but have case number already, this is really confusing does anyone of you guys experienced something like this?

i hope it is only RFE not denied :) i am praying a lot whew! so stressful but it is ok i just really want to be with the man i really love

We had kind of the same thing happen. Basically they haven't done anything with your petition except acknowledge it's at the service center.

Once someone opens up the envelope, they will process the check. When they notice it is over the amount you will receive an RFE that your application has been suspended and you need to send the correct filing fee in a certain amount of time, for us it was two weeks. The notice will have a number you can call to pay by credit card over the phone with an agent, or you can mail another check.

After the correct payment is made, they continue processing your petition. You will receive another NOA showing proper payment was received on X/X/X date and the process has continued. This little hiccup can add some additional time to the process.

If they havent cashed your cheque it means theyre not going to work on your case.They will mail you back the entire packet together with your payment enclosed with instruction on what was wrong, how to correct it and a yellow paper that you will mail back again with right amount. Call again tomorow, sometimes those customer service agent doesnt even know what theyre talking about. tell your fiance to ask to be escalated to a supervisor, someone that can tell him more about the case

We sent the wrong fee, they sent the whole thing back just like they told you, with a sheet of instructions of how to send it back correctly. It's not a big problem at all.
