Do I need to do a name change with USCIS?

Hello everyone,

I just entered the US on a K-1 Visa at the end of October, and just got married on 11-11-11. (woohoo!!)

Just a quick question about how to go about changing to my married name. I have already applied for SSN in my married name, and I plan on getting my driver's license in my married name as well. So I got a few questions.

1) For the I-94 and my passport, do I need to change these, or can they remain in my maiden name for now?

2) I plan on filing for my AOS/EAD/AP in the next week or two, and I will be filling out the forms in my married name. Is this okay, or do I need to file a formal name change with USCIS?

I'm just nervous about having my passport and I-94 in my maiden name, and all my US identification is being completed in my married name....not sure if this is going to give me problems. As soon as I have AP, I am planning on going back into Canada to have my passport re-issued with the new name, but I want to make sure there will be no problems between then and now. (I also don't know if they expect you to get a new I-94 issued also....)

Any advice from anyone that knows or has gone through this already would be greatly appreciated!!

When we filed for my AOS, I used my maiden name. But my SSN and driver's license are already in my married name. Then when we had our interview, the interviewer asked me if I would like to use my married name. And of course, I said yes, then showed him my SSN card, driver's license with married name and maiden name and passport and I-94.

I think it is okay to use either names.

I was on B2 visa, husband is US citizen.

08/2011 - Got married.

08/19/2011- AOS Application filed (I-485, I-130, I-765)

09/02/2011- NOA of Acceptance

09/27/2011- Biometric Appointment

10/18/2011- EAD approved

10/25/2011- Interview letter invitation

10/27/2011- EAD card in hand

11/16/2011- Interview date (Approved on the spot, no stamp on the passport)

11/17/2011- Card production

11/22/2011- Post-Decision Activity that USCIS has mailed the noticed of the approved I-485 application.

11/25/2011- Received the GC and Welcome to the USA letter! Thank you VisaJourney! Thank you Lord!

1) no change in name needed for i-94 or passport for leaving. remember, you used your maiden name in your I-94 coming to the US and you will surrender that the first time you leave as a pending AOS applicant (your AP is required for reentry to US not coming back) remember though that if you're going to fly, to book your name still in the name in your existing passport (they have to match). once you get a new passport in your married name you will still need to show/attach your old passport to show the stamps and that you left with your old passport and coming back with a new one. you shouldn't have any problems. =)

2) it's ok and there is no other formal process to change from your maiden to married name other than in your AOS form (whatever you want your name to be in your GC)

You are allowed to apply for a new passport by mail from the US as well.

1) The passport can remain in your maiden name for now.

2) You can fill out the forms in your married name.
