Is expediting due to pregnancy possible?

Hi there,

I just wanted to see if anyone has had experience expediting a I-130, and if so, is pregnancy considered a sufficient medical condition to warrant requesting expediting?

I am a USC just starting the I-130 process for my husband who is overseas in Australiia, and I just found out that I am pregnant. While it is of course great news, the thought of going through the entire pregnancy alone and possibly giving birth before his greencard/visa is approved is devistating.

Does anyone know if a pregnancy of the US spouse petition would be reason to qualify for an expedite request?

It would be considered if there was a problem/emergency life threatening with the pregnancy with lots of medical proof tho...

If that were the case, many couples would try to get pregnant to expedite their processes. It's something USCIS does not allow, in general.

Sorry dear, unless there's serious complications with your pregnancy but that will need lots of medical proof... I been through that myself and tried sending a pregnancy letter given to me from my doctor, it was of no help..

Just hang in there tight, i know its not easy going through being pregnant alone, just hope and pray that all comes thru fast, all the best with your immi case n also your pregnancy, tc

All of the above answers are correct. You would need a good medical reason signed by your doctor. Dropping your dime and pregnant is not a reason for expedite.

Think of the good though the wait is there.

unfortunately no if that were the case i wouldn't still be stuck in canada my son is almost one but that's only bc everything that could go wrongwith our process has and now my husband's on deployment

Oh dear, I am so sorry. The CR1 process can easily take 9 months or longer too...

I would suggest that you a) go to Australia for the duration of pregnancy if you can get a visa fairly quick and don't have to worry about job prospects or b) Have your hubby visit you on the VWP (is he an Australian citizen? Should be able to qualify if he's not had any immigration/legal trouble) for the last 2 months (2 months pregnancy, 1 month post-partum?)

Get the process started ASAP and get everything turned in. Some people can get in quicker than 9 months, but it's a lot due to luck of the draw (although you can take a bit of control of the NVC process).

No. Sorry. I agree with others who said he should visit you on the VWP (unless he has disqualifying factors).

Your flag says UK. Is he applying in the UK or Australia? The reason I ask is you can come over to the Aussie chat pages to ask for current processing times in Australia (which is quicker than the UK).

NO-but I have a friend of mine whose Fiancee had to wait AFTER she delivered the baby in her home country before migrating since she was about 7 or 8 mths pregnant at the time .

Do you really want me to answer that..? It's not likely to be answered in your favor so i'll let it sit. It is still the same all that could have been avoided... Prove otherwise.. If you can't then why did u even talk ...? The post is old, answers received and recorded.. You didnt even have an answer to give. What are you trying to accomplish...? No answer needed for this but you may choose to direct any other messages or announcements to the poster.
