Hello Everyone,

I am in the process of applying for a passport for my minor, adopted child. She is presently a permanent resident, and qualifies for citizenship having met all the requirements. The passport instructions state that we need to submit proof of physical and legal custody. What type of evidence should I submit to support this? I feel like the final adoption certificate satisfies the legal custody portion of this, but how do I show evidence of physical custody for a minor child?

Only way to apply for a US passport is to physically visit one of their 12 service centers or one of their 9,000 agents. We even have two in our dinky little town for the agents. Why don't you visit yours and ask the agent what they want. I did adopt a couple of kids, got a birth certificate showing me as the parent, but really am stumped as to how, if I had to prove, I had physical custody of them.

My only guess would be a couple of notarized signed affidavits from witnesses. But was never put into that position, see what your agent has to say about this. Can also bring the child with you.

We just got a US passport for my daughter... because of her age, both parents were required to be present at application time... I assume if there was a "custody" issue it would have been addressed at that time... but nothing that I remember was anything that I specifically had to do in that regard. Just go to the agent office
