Hi,

My wife is an American citizen. My daughter got her GC in mail today. I did not get my GC yet. Do I need to wait for my GC befoe my wife can apply for an American passport for our daughter?

I adopted my husband's kids in November 2010. I had to submit school records (report card), doctor's invoice, etc. to show they were living with me. That was proof of custodial.

When we applied for the passport the adoption decree was necessary also. But then DOS called me and needed more information, their greencards, their original passport showing the entry stamp, and the above mentioned documents showing custodial custody.

They issued their passports and I got all the original paperwork back, too. I really did not feel well sending all originals, but that is what they required.

My wife is an American citizen (naturalized in 2003). She was living in Egypt with her parents who r working as flight attendants. My wife and I live in Canada. Our daughter ( 9 months old) was born in Canada. My wife applied for our daughter and for me to get GC. All of us entered USA as LPR in Septemeber, then we travelled back to Canada until my contract will be over in Feb 2012.

My wife wants to go to USA to apply for a passport for our daughter. What will be the best time to go there: next month or wait until Feb 2012?

Does our wife fulfill the residence requirements mentioned below?

(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years: Provided, That any periods of honorable service in the Armed Forces of the United States, or periods of employment with the United States Government or with an international organization as that term is defined in section 1 of the International Organizations Immunities Act (59 Stat. 669; 22 U.S.C. 288) by such citizen parent, or any periods during which such citizen parent is physically present abroad as the dependent unmarried son or daughter and a member of the household of a person (A) honorably serving with the Armed Forces of the United States, or (B) employed by the United States Government or an international organization as defined in section 1 of the International Organizations Immunities Act, may be included in order to satisfy the physical-presence requirement of this paragraph. This proviso shall be applicable to persons born on or after December 24, 1952, to the same extent as if it had become effective in its present form on that date;

If she was naturalized, she had to live in US for quite a while.

If so your daughter is already US citizen and does not need a green card! Your wife should file a Certificate of Foreign Birth with the US embassy in Canada and apply for a passport directly. Why did your daughter need a green card?

My daughter needed a GC 'cause my wife did not fulfill the 5 years period (2 of which after she was 14). That is why she needs a GC when admitted to USA and then she will be eligible for citizenship according to Child Act 2000.
