Several of us have asked in the proving domicile outside of the US thread without an answer so I thought I'd ask here. Do you have to have proof of domicile if the petitioner lives in the US and always has when filing a K-1 visa? What sort of proof of domicile is necessary? All my paperwork has been filed with my fiancé's American address listed - is that enough?

No you don't. This is a non-issue.

No of course not, i'm not sure at all, I didn't do a k-1 with a guy who never once left the USA....headbonk.gif

Yes i'm sure i already did this. We already went through this there is no domicile issue when you file a K-1, the domicile issue is with spousal visas.headbonk.gif

Mind you this post is Canada-specific. It could be a different answer for an interview in another country.

(but after reading Inky's most recent post it could just be a straight answer across the board)

this issue keeps comming up for no reason. the checklist that asks for domicle is a GENERIC one used for BOTH TYPES OF VISAS. but if you read the uscis site you would see you dont have to prove domicile for a FIANCE K1 VISA. Especially since the rule is that you have to be a us citizen living in the usa to even petition your foreign born fiance.

No worries--I think someone else already took care of that,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
