Ok so I am going to be filing all of my paperwork this upcoming month, yes I am planning to talk to my lawyer about my questions but I was wondering if anyone had any clue about this.

So, my husband worked at walmart from February 2010 to Oct 2011, Oct 25th this year when he went active duty in the Army. I864 asks to show proof of income, tax returns for most recent tax year, etc etc. But what to do when the latest tax return is UNDER the poverty limit, and he just started his new job not even a month ago, but being an active duty service member would put us over the poverty limit? What to do? Do we still file with a joint sponsor?

Just because hes active duty does not mean hes over the limit. Its based on pay. Brand new recruits don't make over the limit i know this because my husband didn't make over not even 100% over the limit for military when he first started. In the first 2 years he didn't make above it lol.

He needs to find out his annual pay list for his rank. He can also print out a copy of this to include in the packet, it should list any promotions he has coming up too.

He needs to print off his LES statements as they come and collect them.

He needs to get a letter from his command or first shirt etc.
