Common misconception about K1

Let's define a "clean" K1 petition as one that does not require an RFE nor does it trigger any alerts in any world-wide databases nor does it trip any other delay causing mechanism in place.

Simply put, a "clean" K1 petition can be approved in 20 minutes' time. So, if that same "clean" petition took 5 months to be approved, it means that "clean" petition waited five months for an employee to finally open the box in which it was contained and approve it.

I bring this up because I have read in many threads that people believe shorter approval times means those people did a better job preparing their petitions. In reality, it just means they got lucky that their petition was selected and processed sooner.

Let's leave RFE's and expedited petitions for another thread.

Any other misconceptions out there about K1 petitions that I might be guilty of believing?

I agree. Short approval times (for NOA2) doesn't have anything to do with preparation. It CAN but it doesn't necessarily.

I think it's a bit of a lottery myself, little to do with being well prepared. Of course we all want to be well prepared though given a choice ;) It seems some get no RFE and still have to wait five-seven months....we had our NOA2 at four months....if it was anything to do with being well prepared we should've got it at one :bonk: My fiance is super organised!!

Well said. I had a very short Noa1 to Visa in hand time. People asked me what I did or did the fact I used a Lawyer speed it up. I always say. My Lawyer was a complete waste of money and that I just got lucky. My K-1 petetion came up at the exact time Vermont had reallocated people to clear out the K-1's. I just got lucky.

Good summary. It has been pointed ut here many times. Some people still seem to think that there is some huge proces and commitee meetings or votes or something. Nope, just one person looking at your file and approving it or sending an RFE.

"Good preparation" in my opinion means getting evrything you need and presenting it. It does not matter HOW you put it in the envelope (they change all that when it gets there) but it matters that it is IN the envelope.

Yep - 2 service centers. Besides the fact that the process takes so long, you'd almost expect our government to have 50-100 centers and the process would STILL take as long...

No....what is means is that there is about a 5 month backlog of cases ahead of any one persons. Period. They have that many to go through. Period

Clean petition.. but someone who has a problem is ahead of you. When that application that got problem answered back, the reviewer has to get back to it and review again to see if there's another problem. So we have to help each other because those peeps that got problem slows down the smooth process.

Remember, your dealing w/ federal employees who have a gravy government job and are in no hurry to expedite anything. If you dont know what I am talking about then go to your local IRS office to get your W-2's & tax returns for your I-134 or even go to your local post office, they move the same speed it there are 2 or 200 people in line.

FYI, K-1 approved today!!!!

115 days to get NOA2, less than 3 weeks to go from USCIS to NVC to Manila.

12/30/2011...........LA VISA APROVADOOOOOOOOO!!!!!!!!!!!

01/12/2012...........Case Sent To Bogota Colombia, from the National Visa Center.

02/09/2012...........Schedule Interview.

03/23/2012...........Interview (to take place then)!

04/07/2012...........Arrived in USA.

07/01/2012...........MARRIED!

What next?

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

I honestly think not only backlogs but isn't waiting all these months apart from your love one the test the government wants to prove any relationship.

And if it proves anything, I didn't find this site until after I sent my K-1 out, I didn't put it together as cleanly as the guides here say.. no cover letter and my letter of intent wasn't close to the sample, yet I have one of the fastest NOA1 to NOA2 approvals (That I've seen on this site). So it has nothing to do with the preparation of the petition!!

July 23rd - 30th, 2008 -- Damian's Mum Comes to the US for our wedding.

July 25th, 2008 -- Wedding Day!

March 16th, 2009 -- AOS Sent

May 8th, 2009 -- EAD & AP Approved (51days)

July 14th, 2009 -- AOS Approved!! (118days)

July 21st, 2009 -- Green Card Received (125days)

No RFEs the whole process :) All done myself.

December 4th - 30th, 2009 -- Visited England

April 8th - 30th, 2010 -- Damian's Brother visits us here in PA.

January 19th, 2010 -- Damian got his PA license.

December 10th - 19th, 2010 -- Visited England

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!
