Quick Question on 1-130

Hello Guys.

This question am asking on behalf of a friend. so here is his story.

He got married to a US Citizen and was able to get his permanent residency the marriage didn't work out and they got divorced last year. He got his permanent residency 2008 and was able to get his US Citizenship. So this year he met a woman and he wants to get married. However there is this section on the 1-130 that he needs clarification on

" WHO MAY NOT FILE FORM I-130

5. A husband or wife if you gained lawful permanent resident status by virtue of prior marriage to a US Citizen or lawful permanent resident unless

A. A period of five years has elapsed since becoming a permanent resident

B. You can establish by a clear and convincing evidence that the prior marriage through which you gained immigrant status was not entered not for purpose of evading any provision of the immigration law

C. Marriage terminated by the death of former spouse."

So we want to know what he has to provide to USCIS for B.

Any help would be great

It would look a lot like the evidence of a bonefide relationship , concentrating of the time after he enter the US and was happily living with the ex wife. It may look like the same stuff he used for ROC .

This will not be over quickly. You will not enjoy this.

i see red flags everywhere on these matter...first why so much now in a hurry to remarry and go thru stressful petition process again?were is the present fiance from and how did they meet?u just got outta a failed marriage...why the hurry to hop in again...my advise just take sumtime off from the process cos USCIS is watching u...u might spoil it for u and ur fiancee now....take a break bro......
