Hi,

It’s what you need to consider in order to determine if a child must be include in the parent petition or she/he must file separately.

• If the alien child acquired status (green card approval) at the same time or within 90 days of the alien parent, they can be included on the alien parent’s I-751 petition.

• The alien’s children can be included on their parent's I-751 petition if they immigrated at the same time or within 90 days of their alien parent.

Hope this helps you, good luck.

751 is not a joint petition for them. They each have to file their own.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Any child that is seeking to file for removal of condition and meet the terms posted above must be included in the parent application on the part 5 of the form I-751. Just have to add the Biometric fee for the child.

I guess that the OP knows that the term “joint petition” refers to the USC spouse and the resident spouse.
