Hi Vj family! I requested an extension on tourist visa. My i-94 expires soon and the UScis rep

says not to worry about it since my application is being process. I'm not comfortable with that response. Anyone have been through this? Should i wait for decision? Would waiting affect my immigrant visa process?

If you have your NOA from the application - your good to go - you should wait till you get approved or not.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes i have it with a receipt number but I'm concern re validity of my visitor visa if the decision come and i am not approve.Anyone has been through this process? Pls respond

If you are not approved - you will be told to leave the country ASAP (usually given 30 days).

It would not affect your visitors visa. Why would it? As long as you stay in the US, not violate the terms of your visa, you will not get in trouble for filing.

As long as the I-94 was still valid (your status was still good) - when you applied for the extension - your good to go.

Think about it this way - if you apply for an extension - then leave before you find out if it is approved, why file in the first place?
