No current tax return for K-1 Interview. Problem?

thanks...2011 is not due until 2012 April 15, or 2012 October 15 with an extension. Unfortunatley, I cannot get a new accountant now. I do have a solid Co-sponsor who has completed paperwork. I appreciate eveyone's conjecture, but hope to hear from someone who has a definitive answer to my two questions. Thanks again to everyone! :)

Maybe getting your 2010 taxes completed will help. Thats a start.

Also, I don't believe its your Accountants fault you did not File for 2010.

Put the blame where it needs to be. You said: My accountants mistake. No. I don't buy that.

Every year I send all my tax documents to my acountant in February. He usually waits until the last minute to file. I have a complicated financial situation and feel fortunate to have been working with him for the past decade.

This year I can only guess about the reasons why he hasn't filed/replied to my emails for he past several months. My best guess is that since I am due a refund this year that he's still sitting on it.

It's an unfortunate coincidence that this is the frist year that I don't have a copy of my current tax return by October, and this year I might really need it. :)

It appears an denial will only result from ones inactivity or lack of activity in your case. This process is difficult at best, be prepared. good luck.

OH BS... If you have a return and not owe, why ask the extensions. Moreover, you Finacee has a interveiw soon. If your broke and need a Co-sponsor you would have taken the money. NO?

I don't have anything do do with when or how my tax returns have ben filed for the past decade. Each year in February I simply give my tax information to my accountant, who prepares my taxes (usually at the last minute!) My income from Rental Property and work this year is near $65k, and I have copies of signed leases, bank deposits made by tenants, three previous years of tax transcripts, a copy of my Credit Report (760s), bank statement, employer statement, and a Co-sponsor--but my questions here is:

Will a lack of a 2010 tax form absolutely disqualify me, and if so will they accept am emailed copy of my 2010 taxes whenever I get ahold of them, or will a second full-blown interview be necessary?

I can't imagine why you feel that because you are owed a refund is a good reason to wait to file your return. I would want that money ASAP. Plus you are giving the Govt an interest free loan. If your refund is large, your accountant should adjust your withholding or estimated payments so that you don't have such a large overpayment in the future.

Definitely time for a new accountant if he does not reply to your emails!

I appreciate suggestions that I get a new accoutant, claim my refund quickly, should have done something differently, change my hair color, etc.--but my fiance and I hope to get a more definitive answer about my 2010 Tax Return before she goes to her Interview. :) Thanks again to everyone in the VJ Community! :pop:

The most recent tax return requirement is not simply about helping to prove income, but is also required to prove that you're a good person who files taxes. Given that it is now November 2011 you will be required to either show your 2010 tax return or provide a good explanation as to why you do not have it. Prior to October proof of an extension might have sufficed, I don't know. But at this point I don't see an alternative to providing the return. Of course with immigration anything is possible: they might get confused and forget to ask you for it. That's not impossible. But unlikely. Generally, they would give you a chance to provide it after the interview, and generally that would not require another interview. (But just as it's possible for them to do something stupid in your favour, it's also possible for them to demand a second appearance by your fiancée rather than just asking for the missing document. I don't know how Moscow tends to be. In the UK I would feel confident telling someone that they would just have to send the document to the Embassy when they got it.)

Anyway, right now about all you can do is bombard your accountant with emails and phone calls. Maybe even ask a friend if they can talk to him in person.

Not all consulates require the last 3 years of tax transcripts, but they all require at lest the most recent, which is 2010. You will need that, or a statement explaining the reason you did not file and do not have the return for it. This late in the year I am not sure the extension reason will fly with them. You really need to get a copy of your 2010 return.

I've already answered your question twice.

Will they deny you outright? Probably not. They will probably request your 2010 tax return and delay visa approval until then. In that case, your fiancee would have to return with the proper information and they would look it over and approve you (or deny if it did not meet the requirements).

Since you have no idea what your accountant is doing, I would get a letter from him explaining why your tax return has not been filed. As others have mentioned it just plain looks bad if you are beyond the time in which you can file. You need to demonstrate that you have attempted to file. Still, I think you are negligent in not knowing what the heck is going on with your tax return.

There is no "definitive" answer to your question but I have done my best to answer it a few times now. Good luck.

The problem is zero response from my accountant over the past two months. I'm in Russia for the month, and the Interview date is nearing.
