Joint Sponsor Required

Hey guys,

We had our visa interview and everything was great, except they said that I didn't meet the requirements to be a Sponsor. The job that I have right now meets the 125% above poverty income requirements, so I'm not sure what went wrong. Does anybody have more experience with this?

They gave us 30 days to provide the documents for a joint sponsor.

Sorry about your interview problems.

1) How much do you earn?

2) How many in your household?

3) How long ago did you start your job?

4) What did your 2010 taxes show as income?

5) Did you provide recent pay stubs?

6) Did you provide letter from employer?

Once we know this then we can give accurate advice.

With a K1 the Consulate have freedom to ask for what they want.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

It's your length of time on the job that is causing the problem, linked with your low income from 2010.

Get a co-sponsor lined up like TODAY and get the information back to the Consulate ASAP. If you miss the 30 day deadline your petition will be sent back to USCIS and it will expire and die a natural death. Then you are stuck filing again and beginning the process from the beginning.

Exactly. The Consulate has absolute authority to approve or deny the visa based upon his interpretation of the OP's income. In this case, the short job time coupled with the low earnings from 2010 makes the Consulate unsure of the OP's long term earning capacity and therefore will require a co-sponsor who shows the necessary income AND stability.

It sucks, because in a different Embassy perhaps a different Consulate would have approved the visa based solely upon the OP's CURRENT income.

Thank you for all the feedback guys, it really helps!

We are working on getting a joint sponsor and I am excruciatingly aware that if we don't get this now... we're going to be waiting a long time again :)

I know it doesn't seem so, but in a way you are VERY fortunate...

1) Your fiance is from a country that accepts co-sponsors. Some Embassys do NOT.

2) The Consulate did not deny your visa application on the spot for insufficient income and is giving you 30 days to obtain a co-sponsor. He could have just as easil denied the visa and immediately sent the petition back to USCIS for you to either appeal or wait out the expiration.

3) A co-sponsor will only be needed for the K-1. By the time you get to the AOS, your job length will be sufficient that you'll qualify on your own income. It is much easier to get someone to co-sponsor for the K-1 on the I-134 which is a non-enforceable affadavit of support. When at the AOS phase, the I-864 is used which carries some very serious ramifications regarding repayment to the US Government should your fiance ever become a public benefits recipient.

Good luck getting your co-sponsor lined up. Make sure to get the docs to the Embassy well before the 30 day time limit expires!

Good luck finding a cosponsor, my current job (past year) qualifies, but a lawyer insisted on a cosponsor because the past couple years my income was way insufficient.

Would you mind sharing how long you waited after the case complete at NVC until your interview date? Right now our packet has just arrived in Tegus and we are waiting for a date...I am praying for December

Did you go to the interview? I want to but of course need to coordinate with work schedule.

Hi, to all you from Honduras that already went to an interview I have a quick question...I am trying to have things ready for whenever we have an interview (we are still waiting for a reply form USCIS and we filed 5 months ago) but I dont know how to get the police certificate...Can I get it in San Pedro or do I have to get it in tegucigalpa. Does it need to be certified by both honduras consulate and us embassy before sending to the nvc? Thanks!
